I am writing to request an internal review of City of York Council's handling of my FOI request 'Information about your dealings with Stonewall.
I am not persuaded that a full account has been provided in answer to the questions I originally asked. Namely, no information has been provided as to applications made in 2019 and 2020; no feedback has been sent through regarding that application from Stonewall; no details of any Equality Impact Assessment has been submitted (or evidence that one was carried out); no indication has been given as to whether York City Council intends to maintain their membership of the scheme and no details provided of any money paid to Stonewall for services provided.
Such information will and ought to be available. As a member of the Diversity Champion Scheme Stonewall will have provided feedback in the form of email communications that are disclosable under FOI legislation.
I do not think your approach to this question is consistent with your duty under section 16 of the Freedom of Information Act to provide advice and assistance to me as a person who has requested information from you, and I would ask you to have careful regard to that duty in dealing with this application for review. In particularly, if you consider that taken literally my request would put you to excessive cost, but you can see a different way of formulating my request that would make it possible for you to respond in substance, then you should suggest that reformulation and offer to respond accordingly.

I have now completed a review of how the council has dealt with your
request under the Freedom of Information Act (FOIA).
You do not believe that you have been provided a full response:
· no information has been provided as to applications made in 2019
and 2020
· no feedback has been sent through regarding that application from
Stonewall
· no details of any Equality Impact Assessment has been submitted (or
evidence that one was carried out)
· no indication has been given as to whether York City Council
intends to maintain their membership of the scheme and no details provided
of any money paid to Stonewall for services provided.
Looking at the response it explains that there is not an application
process to be a Stonewall Diversity Champion it is a membership and City
of York Council do not hold any application information. City of York
Council did not make any application to be included in Stonewalls
“Workplace Equality Index,” in 2019 and 2020 therefore we do not hold this
information.
It further explained that we do not hold any information in relation to
feedback received from Stonewall with regards either application or
programme as we have not applied for either in 2019 or 2020. It also
states that no EIA was completed as no applications were made. Therefore
this information is not held.
It also advised that no decision has been made to whether the council will
maintain its membership.
Recommendations/Conclusions
I can confirm that the council has provided you with all the information
we hold therefore this complaint is Not Upheld.
