I am writing to request an internal review of Sunderland City Council's handling of my FOI request FOI_3361 'Information about your dealings with Stonewall CYPS #DontSubmitToStonewall'.

Your response omits information requested so this is to request an internal review.

1. Any application you made in 2019 or 2020 to be a “Children and Young People's Services Champion” or for Children and Young People's Services to be included on Stonewall’s “Workplace Equality Index,” including any attachments or appendices to those applications. Please redact personal details if necessary.

You say: “TfC have never submitted an application.”

Please review.

The Stonewall Children and Young People's Services Champion programme offers an CYPS Champion Award, benchmarking and in-depth feedback on your practice.

So it is likely that Together for Children’s files hold relevant info on TfC participation in the CYPS Champion programme. I do not accept that you do not hold or have access to this information electronically and/or:
- final drafts for the Stonewall Children and Young People's Services Champion application
- and current year evidence submitted
- and/or have shared the finished submission with management
- and/or have links to references, attachments or appendices or other additional information & research for the submission
- and/or CYPS Champion award results and feedback

Organisations receive their scores and in-depth, tailored written and verbal feedback to use as a foundation for future work and action plans.

3. Any other communication you have received from Stonewall in 2019 or 2020 or 2021 unless privileged or otherwise exempt from disclosure (but if you claim privilege or exemption in relation to any material, please say in broad terms what the material is and the basis on which you claim to be entitled to withhold it).

You say: “Our Anti-Bullying and Engagement Manager was main contact and left the organisation in January 2021. We could only provide communications between the manager and Stonewall by requesting our ICT department to relocate historical emails, however as the account has been deactivated this would not be possible.
The RSHE Co-ordinator has had a brief contact with Stonewall in September 2020 regarding a 2hr training session on Thursday 8th October around LGBTQ+ young people for the wider RSHE Team.
The RSHE Co-ordinator has had a further conversations with Stonewall to seek advice regarding questioning young people and their rights. Unfortunately, no emails were saved and were automatically deleted after 90 days.”

I do not accept that you hold no information from Stonewall and the CYPS Champions programme with recommended actions on your policies and activities.

Stonewall say they are continuing to provide in-depth, tailored feedback on through the programme and also provide you with best practice examples and ways they can support you further in your equality work.

So communication is likely to have been forwarded to your colleagues working on CYPS policies and implementation and your Employee Equality Network.

I direct your attention to your section 16 duty to provide me with advice and assistance. The specific assistance I would like you to provide me with to help me to refine my request and make it possible for you to comply without incurring excessive costs is a list of other custodians (by job title; I do not need to know names) you believe to have been the recipients of such communications.

That, of course, does not exhaust your duty to provide me with advice and assistance: you should also turn your minds to any other ways in which you can help me to refine my request so that it captures a representative picture of your dealings with Stonewall without exceeding the appropriate limit.

4. Any training reports you have received from Stonewall in 2019 and 2020 and 2021 and details of online training completed by your staff, with staff title by month in 2019, 2020 & 2021. Please redact personal details if necessary.

I am a solicitor employed by  Sunderland City Council and I have been
instructed to carry out a review of the response you received on 5th March
2021 to the FOI request you submitted on 14th February 2021. For the
purposes of this review I am solely concerned with the responses provided
by Together for Children.

 

Within your request for a review you asked that the responses to questions
1, 3, 4 and 7 of the original request be reviewed.

 

Question 1.

You asked: 1. Any application you made in 2019 or 2020 to be a “Children
and Young People's Services Champion” or for Children and Young People's
Services to be included on Stonewall’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

 

TfC responded: “TfC have never submitted an application.”

 

I have reviewed that matter and am satisfied that this is correct.
However, Sunderland City Council has submitted applications previously.
But TfC and Sunderland City Council are separate legal entities.

 

 

Question 3.

You asked: 3. Any other communication you have received from Stonewall in
2019 or 2020 or 2021 unless privileged or otherwise exempt from disclosure
(but if you claim privilege or exemption in relation to any material,
please say in broad terms what the material is and the basis on which you
claim to be entitled to withhold it).

 

TfC responded: “Our Anti-Bullying and Engagement Manager was main contact
and left the organisation in January 2021. We could only provide
communications between the manager and Stonewall by requesting our ICT
department to relocate historical emails, however as the account has been
deactivated this would not be possible.

The RSHE Co-ordinator has had a brief contact with Stonewall in September
2020 regarding a 2hr training session on Thursday 8th October around
LGBTQ+ young people for the wider RSHE Team.

The RSHE Co-ordinator has had a further conversations with Stonewall to
seek advice regarding questioning young people and their rights.
Unfortunately, no emails were saved and were automatically deleted after

I have reviewed that matter and am satisfied that this is correct the
Council’s email servers are used by TfC and emails are automatically
deleted after a period of 90 days unless specifically saved into a file
management system. Personal emails and emails not related to current live
files are not permitted to be saved into the case management systems.

 

Question 4.

You asked: 4. Any training reports you have received from Stonewall in
2019 and 2020 and 2021 and details of online training completed by your
staff, with staff title by month in 2019, 2020 & 2021. Please redact
personal details if necessary.

 

TfC responded: “We have received no training reports. Stonewall delivered
training for foster carers in 2019.

Face to face  training 1 day for 36 foster carers on 13/06/19. We do not
have records regarding any staff attending.

The RSHE team of 2 members (RSHE workers) attended a 90 minute training
input titled Supporting Trans children and Young People. We do not hold
any further information on file.

 

Titles of the 2 RHSE employees and the format &  areas covered in the 2
hour online training course on 8 October 2020.

The titles are ‘RSHE workers’ who received a 2 hour online training course
around LGBTQ+ young people on 08/10/20

Membership Lapsed Jan 2021 renew decision 23/03/21 as we were waiting to
confirm finance for the membership.
