FOI, Request (CENTRAL LONDON COMMUNITY HEALTHCARE NHS TRUST), Central London Community Healthcare NHS Trust

Dear Sir or Madam
Under the FoI Act 2000 a requester should provide enough of their name for us to be able to identify them. Whilst you have provided a surname. You have not provided a first name and as such we have no way of identifying if you are male or female.
Please therefore resubmit your request with enough information and we will happily process it

Dear FOI, Request (CENTRAL LONDON COMMUNITY HEALTHCARE NHS TRUST),

Re your response to my FOI request, I am baffled as to why you should need to know whether I am male or female, in order to process my FOI request. I am not aware that this is a requirement, and have never had this response to any other FOI requests i have made from any other public body.

Under GDPR I'm not sure you have the right to request or hold this information, as I cannot see how it is relevant to my dealings with you; further I would ask you to reflect on the fact that some people do not identify as either male or female, or identify as a gender not matching with their biological sex. Therefore I suggest your refusal to answer my FOI without my stating whether I am male or female is discriminatory and possibly illegal.

Yours sincerely,

J Whitby-Fretwell

It’s still going to be 20 days from the first request as they don’t need to know if you’re mail or female. The public body not reading the guidance properly doesn’t extend the time limit!

Dear FOI, Request (CENTRAL LONDON COMMUNITY HEALTHCARE NHS TRUST),

I have supplied you with my name, and have never refused to do so. You seem to think that I am required to supply you with my sex, which I am not. I find it very strange that you appear to be trying to avoid answering my FOI request in this way. I would prefer you answer my query, but if necessary I will escalate your refusal to do so.

Yours sincerely,

J Whitby-Fretwell

Dear Central London Community Healthcare NHS Trust,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Central London Community Healthcare NHS Trust's handling of my FOI request 'Information about your dealings with Stonewall #DontSubmitToStonewall'.

I remain confused as to why you are insisting to know my first name before processing my FOI request. It appears that you are unable to answer until you know if I am male or female, which is not pertinent to my request and not grounds for you to refuse my FOI. Therefore I request you respond to my FOI.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/i...

Yours faithfully,

J Whitby-Fretwell

FOI, Request (CENTRAL LONDON COMMUNITY HEALTHCARE NHS TRUST), Central London Community Healthcare NHS Trust

Dear Requester
We do not require to know whether you are male or female. However under the Freedom of Information Act Section 8 it is a requirement that we have any requesters real full name and their address. For the sake of FoIs an address can be an email address. The ICO guidance states "For a request to be valid, the requester must provide enough of their real name to give anyone reading that request a reasonable indication of their identity" We are genuinely not trying to be difficult but for you we have an initial and a surname. Ironically were you identified as Ms, Mr Mrs etc then we would not need the first name. But an initial is not considered an identifying feature. Please just provide a first name or an identifier and we will be more than happy to process your request.
Best wishes

Champion” or to be included on Stonewall’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

We are currently Stonewall Diversity Champions - and have been since 2018
- you can view the Stonewall Diversity Champions logo on our website - see
[1]https://clch.nhs.uk/job/equal-opportunit...  We applied to the
Stonewall WEI 2020 - see attachment 1 (as it was an online application, we
received a PDF version ).

Any feedback you received in 2019 or 2020 from Stonewall in relation to
either application or programme.

See Attachment 2.

3. Any other communication you have received from Stonewall in 2019 or

connected with any of these applications (including any equality impact

evidence we supplied supported this.
