Having considered your request we can confirm that we do hold information

of the Freedom of Information Act as complying with the request would
exceed the appropriate cost limit.  Our IT contractor has confirmed that
undertaking the mailbox restoration and subsequent searches of those

your request will take 10 days at a cost of £364.00 per day, totalling 70

stipulated by the Freedom of Information Act.

We are sorry that we are unable to assist you on this occasion.  We could

Dear East Sussex Fire and Rescue Service Freedom of Information Requests,
Thank you for your reply. The questions were drafted by a lawyer, and so I wonder whether simplifying would make my questions easier to answer? Can I please ask the following simplified versions.

1. Were you a “Stonewall Diversity Champion” or were you included in Stonewall’s “Workplace Equality Index in 2019 or 2020? Did you make an application to Stonewall to be a SDC or in their WEI in these years?

2. Did you receive any feedback in 2019 or 2020 from Stonewall in relation to either application or programme?

3. Did you receive any other communication from Stonewall in 2019 or 2020 unless privileged or otherwise exempt from disclosure (but if you claim privilege or exemption in relation to any material, please say in
broad terms what the material is and the basis on which you claim to be entitled to withhold it)?

4. Did you carry out any equality impact assessment connected with any of these applications (including any equality impact assessment carried out prior to an earlier application of the same kind, if no further assessment was done)?

5. How much money did you pay to Stonewall (i) in 2019; (ii) in 2020, whether or not as payment for goods or services?

6. Do you intend to continue your membership of either of the Stonewall schemes in the future, and if so which?

I do hope that this will make the tasks much easier. If so, can you please reply by 19th April?
Thank you.

Yours sincerely,

U. Winfield

Freedom of Information Requests, East Sussex Fire and Rescue Service

Dear U. Winfield,

I refer to your Freedom of Information Act request which was received by
East Sussex Fire & Rescue Service on 1 April 2021.

Request:

Thank you for your reply.  The questions were drafted by a lawyer, and so
I wonder whether simplifying would make my questions easier to answer? Can
I please ask the following simplified versions.

1. Were you a “Stonewall Diversity Champion” or were you included in
Stonewall’s “Workplace Equality Index in 2019 or 2020? Did you make an
application to Stonewall to be a SDC or in their WEI in these years?

2. Did you receive any feedback in 2019 or 2020 from Stonewall in relation
to either application or programme?

3. Did you receive any other communication from Stonewall in 2019 or 2020
unless privileged or otherwise exempt from disclosure (but if you claim
privilege or exemption in relation to any material, please say in broad
terms what the material is and the basis on which you claim to be entitled
to withhold it)?

4. Did you carry out any equality impact assessment connected with any of
these applications (including any equality impact assessment carried out
prior to an earlier application of the same kind, if no further assessment
was done)?

5. How much money did you pay to Stonewall (i) in 2019; (ii) in 2020,
whether or not as payment for goods or services?

6. Do you intend to continue your membership of either of the Stonewall
schemes in the future, and if so which?

Response:

Please see our response in bold.

Unfortunately we are still unable to provide an answer to question 2
within the time/cost limitations as stipulated by the Freedom of
Information Act.  We are aware that under the terms of the Act refusal of
part of a request under the time/cost limitation would usually constitute
refusal of the request in its entirety, however, recognising that this was
an amended request and given that we are able to answer the other aspects
with relative ease we have on this occasion provided answers to your other
questions.

1.       Were you a “Stonewall Diversity Champion” or were you included in
Stonewall’s “Workplace Equality Index” in 2019 or 2020? Did you make an
application to Stonewall to be a SDC or in their WEI in these years?

During 2019 and 2020 East Sussex Fire and Service was a member of
Stonewall’s Diversity Champion network, however we were not part of their
Workplace Equality Index at that time. East Sussex Fire & Rescue Service
did make an application to Stonewall to become a Diversity Champion at
this time.

2.       Did you receive any feedback in 2019 or 2020 from Stonewall in
relation to either application or programme?

This part of the request is refused under Section 12 of the Freedom of
Information Act as complying with the request would exceed the appropriate
cost limit. Our IT contractor has confirmed that undertaking the mailbox
restoration and subsequent searches of those emails which would be needed
to ascertain if any feedback was received from Stonewall will take 10 days
at a cost of £364.00 per day, totalling 70 hours or £3640 which is
significantly longer than the 18 hours/£450 limit stipulated by the
Freedom of Information Act.

3.       Did you receive any other communication from Stonewall in 2019 or
2020 unless privileged or otherwise exempt from disclosure (but if you
claim privilege or exemption in relation to any material, please say in
broad terms what the material is and the basis on which you claim to be
entitled to withhold it)?

We can confirm that East Sussex Fire & Rescue Service did receive other
communications from Stonewall in 2019 and 2020. Please note that no
assessment has been made as to whether any of these communications
contained privileged or exempt information.

4.       Did you carry out any equality impact assessment connected with
any of these applications (including any equality impact assessment
carried out prior to an earlier application of the same kind, if no
further assessment was done)?

East Sussex Fire & Rescue Service did not carry out any equality impact
assessments related to the Diversity Champion applications during 2019 and
2020.

5.       How much money did you pay to Stonewall (i) in 2019; (ii) in
2020, whether or not as payment for goods or services?

In 2019 calendar year East Sussex Fire & Rescue Service made payments
totalling £6,000 (including VAT) to Stonewall for Stonewall Diversity
Champion membership for the period 01/11/18 – 31/10/20. We do not hold any
records of any payments made in 2020 calendar year.

6.       Do you intend to continue your membership of either of the
Stonewall schemes in the future, and if so which?

A decision regarding membership renewal will be made in due course.

I hope this satisfies your request, however if you are unhappy with the
way in which your request has been handled, you can ask for a review by
writing to:

Mrs L Ridley

Assistant Director – Planning & Improvement
