You have confirmed that you have paid for annual Stonewall Diversity Champions membership in 2019 and 2020.

Your answer to my 3rd question was:

“May 2019 – Annual catch up with Stonewall client manager on their work and the activity of Scottish Enterprise on equality and diversity. This included advice on setting up of Employee Diversity Networks to support all under represented groups.
August 2020 - Update provided to LGBTI+ Community group on the history of the organisation, the importance of staff networks and allies.”

So your answer does not respond to my request which was for:

Please provide the information requested.

You advised that “In line with our procedures equality impact assessments are not required on initiatives with an equality focus.”

Please provide a copy of those procedures and your equality impact assessment form.

I do not think your approach to these questions is consistent with your duty under section 16 of the Freedom of Information Act to provide advice and assistance to me as a person who has requested information from you, and I would ask you to have careful regard to that duty in dealing with this application for review.

This, of course, does not exhaust your duty to provide me with advice and assistance: you should also turn your minds to any other ways in which you can help me to refine my request so that it captures a representative picture of your dealings with Stonewall without exceeding the appropriate limit.

Thank you for your request for review, which we received on 23 February
2021, regarding our recent response to your Freedom of Information
request.

 

As per section 20(3)(c)(ii) of FOISA, a requirement for review must
specify the reason for the applicant's dissatisfaction with the way the
public authority has dealt with the information request.  You have
requested a review as you consider that SE has not appropriately complied
with its duty under section 16 of the Freedom of Information Act to
provide advice and assistance and, specifically, that SE has not responded
appropriately to your request for communications received from Stonewall
in 2019 and 2020.

In accordance with Section 21 of FOISA, an independent review of the way
in which SE dealt with your request has been conducted and the findings
referred to me.   My response is set out below.

Question 1

Any application you made in 2019 or 2020 to be a “Stonewall Diversity
Champion” or to be included on Stonewall’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

 

The original response advised that no application was made in 2019 or
2020.   To provide further clarification, Scottish Enterprise applied for
membership of Stonewall’s Diversity Champion Programme over ten years
ago.   As this is an annual membership renewal process, a new application
is not required to be made each year.

 

I can confirm that Scottish Enterprise has not applied to be included on
the Stonewall Workplace Equality Index.

 

Question 3

Any other communication you have received from Stonewall in 2019 or 2020
unless privileged or otherwise exempt from disclosure.

 

The original response provided details of communications that Scottish
Enterprise has had with Stonewall.   Following your request for review, we
have now expanded our response to include copies of the individual items
of communication, namely, emails from Stonewall to Scottish Enterprise.

 

Please note the personal information exemption contained in section
38(1)(b) of FOISA has been applied to some of the information you
requested, and that information has been withheld. Further details on our
use of section 38(1)(b) and a schedule of documents is provided at
appendix A.

 

Question 4

Full details of any equality impact assessment you carried out connected
with any of these applications (including any equality impact assessment
carried out prior to an earlier application of the same kind, if no
further assessment was done).

 

In our original response we advised that, in line with our procedure,
Scottish Enterprise has not carried out equality impact assessments in
connection with our Stonewall Diversity Champion membership, as this is
not required for initiatives with an equality focus.

 

In your request for review you made an additional information request for
a copy of our procedures and equality impact assessment form.  Copies of
these are attached.

In other research, I found the EIAs correctly use sex. The Equality Mainstreaming Report April 2019 correctly states the Equality Act characteristics including sex but then erroneously uses the word gender not the protected characteristic sex elsewhere in the report. INFORMATION WITHHELD: Section 38(1)(b) - personal information, together with Article 5(1) of the GDPR creates an exemption from disclosure where the information requested constitutes the personal data of a third party and disclosure of that data would breach any of the data protection principles set out in the Data Protection Act 2018 (“DPA”). Article 5(1) states that “personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject.”
As an absolute exemption, there is no need to consider the public interest in the application
of this exemption.
