Your request will now be considered and you will receive a response within the statutory timescale of 20 working days as defined by the Act, subject to the information not being exempt or containing a reference to a third party. In some circumstances we may be unable to achieve this deadline. If this is likely you will be informed and given a revised time-scale at the earliest opportunity.

There may be a fee payable for the retrieval, collation and provision of the information you request. If this is the case you will be informed and the 20 working day timescale will be suspended until we receive payment from you. If you chose not to make a payment then your request will remain unanswered.

Some requests may also require either full or partial transference to another public authority in order to answer your query in the fullest possible way. Again, you will be informed if this is the case.

I would like to take this opportunity to thank you for your interest in NICE.

Yours sincerely,

FREEDOM OF INFORMATION ACT 2000

Thank you for contacting the National Institute for Health and Care
Excellence (NICE) with your request for information, sent to our office on
8 February 2021, relating to the charity organisation Stonewall.

The Freedom of Information Act relates to recorded information held by a
public authority, at the time that the request is made. I have listed your
questions below and answered each one in turn.

1. Any application you made in 2019 or 2020 to be a “Stonewall Diversity
Champion” or to be included on Stonewell’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

I can confirm that we have been Stonewall diversity champions since 2018
however, we didn’t complete an application form, we had a contract
management meeting where we discussed what our priorities are and how
Stonewall can support us. I can confirm that we have never applied to take
part in the Workplace Equality Index.
2. Any feedback you received in 2019 or 2020 from Stonewall in relation to
either application or programme.

I can confirm that we do not hold this information.

3. Any other communication you have received from Stonewall in 2019 or
2020 unless privileged or otherwise exempt from disclosure (but if you
claim privilege or exemption in relation to any material, please say in
broad terms what the material is and the basis on which you claim to be
entitled to withhold it).

I have attached the information we hold that falls within the scope of
this part of your request.  Some of the information contained in the
document is personal data relating to third parties, the disclosure of
which would contravene one of the data protection principles. In such
circumstances sections 40(2) and (3) of the Freedom of Information Act
apply. In this case, our view is that disclosure would breach the first
data protection principle.

This states that personal data should be processed fairly and lawfully. It
is the fairness aspect of this principle, which, in our view, would be
breached by disclosure. In such circumstances, section 40 confers an
absolute exemption on disclosure. There is, therefore, no public interest
test to apply. We have therefore redacted this information from the
document provided in our response.

4. Full details of any equality impact assessment you carried out
connected with any of these applications (including any equality impact
assessment carried out prior to an earlier application of the same kind,
if no further assessment was done).

I can confirm that we do not hold any information that falls within the
scope of this part of your request.
5. Details of the total amount of money you paid to Stonewall (i) in 2019;
(ii) in 2020, whether or not as payment for goods or services.

I can confirm that in 2019, we paid £3,000 for Stonewall membership and an
additional £230.00 was spent on a conference. In 2020 we paid £3,000 for
Stonewall membership.

6. Whether you intend to continue your membership of any Stonewall scheme
in the future, and if so which.

I can confirm that our membership is shortly due for renewal and we will
make a decision once we have received correspondence relating to our
renewal from Stonewall.

If you have any questions on this response you are welcome to email the
enquiry handling team at [1]mailto:[NICE request email].

If you are unhappy with this response and want an internal review of how
we handled your request, you must write to us within 40 working days of
our response. Send your request to: Associate Director, Corporate Office,
National Institute for Health and Care Excellence, 2nd Floor, 2 Redman
Place, London, E20 1JQ or email: [2]mailto:[email address]. When we
receive your request we will send you an acknowledgement within 5 working
days.

The Associate Director, Corporate Office, will review your complaint and
send you a full reply usually within 20 working days. If you are
dissatisfied with the outcome of this review, you can apply directly to
the Information Commissioner for a decision at: The Information
Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9
5AF.

Kind regards

Katy
