Dear Linda Byrne

We refer to your email requesting information relating to Health Education
England’s (HEE) work with stonewall.

HEE can confirm in accordance with S.1 (1) of the Freedom of Information
Act 2000 (FOIA) that we do hold the information that you have requested.

You can find documentation relevant to your request at the following link:

[1]Folder icon [2]FOI 1205

I should advise you that some of the information in the documentation
provided has been redacted, as it is exempt under section 40(2) of the
FOIA.

Under section 40(2) of the FOIA, third party personal data (personal
information of another person) is exempt from disclosure if releasing
would contravene any of the provisions in the Data Protection Act (DPA)
2018. Such information would not be released under the FOIA unless there
is a strong public interest.

Some of the personal information withheld is classed as special category
data. The General Data Protection Regulations (GDPR) define special
category data as personal data that needs more protection because it is
sensitive.

The GDPR defines special category data as:

·         personal data revealing racial or ethnic origin;

·         personal data revealing political opinions;

·         personal data revealing religious or philosophical beliefs;

·         personal data revealing trade union membership;

·         genetic data;

·         biometric data (where used for identification purposes);

·         data concerning health;

·         data concerning a person’s sex life; and

·         data concerning a person’s sexual orientation.

All persons whose personal data is processed by HEE, regardless of whether
they be staff, trainees or members of the public, have an intrinsic right
to privacy and these rights are protected by virtue of the DPA. Release of
the information subject to the exemption is likely to compromise those
rights. Individuals, trainees and members of staff can expect HEE to
secure their personal information and only process their personal
information in line with the principles contained within the DPA.

I have addressed each of your questions in turn:

 1. Any application you made in 2019 or 2020 to be a “Stonewall Diversity
Champion” or to be included on Stonewall’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

HEE’s Stonewall submission for 2019 is available via the above link. HEE
do not hold an application in 2020 – no application was made as the Index
was closed for submission in 2020 due to Covid-19.

2. Any feedback you received in 2019 or 2020 from Stonewall in relation to
either application or programme.

HEE’s Stonewall feedback report for HEE’s 2019 submission is available via
the above link. HEE do not hold this information for 2020 – no submission
was made due to Covid-19.

3. Any other communication you have received from Stonewall in 2019 or
2020 unless privileged or otherwise exempt from disclosure (but if you
claim privilege or exemption in relation to any material, please say in
broad terms what the material is and the basis on which you claim to be
entitled to withhold it).

Consultancy meeting correspondence with Stonewall as part of preparation
for our 2021 submission is available via the link above.

4. Full details of any equality impact assessment you carried out
connected with any of these applications (including any equality impact
assessment carried out prior to an earlier application of the same kind,
if no further assessment was done).

HEE do not hold this information. No Equality Impact Assessments have been
completed for submissions to the Workplace Equality Index or renewing
membership of the Diversity Champions scheme.

5. Details of the total amount of money you paid to Stonewall (i) in 2019;
(ii) in 2020, whether or not as payment for goods or services.

2019 Membership = £3000

2019 Stonewall workplace conference = £1,750 (£350 per delegate / budget
for x5 / April 2019 event)

2019 Total: £4,750

2020 Membership = £3000

2020 Stonewall workplace conference = £669.60

2020 Total: £3669.60

6. Whether you intend to continue your membership of any Stonewall scheme
in the future, and if so which.

          HEE is committed to remaining a member of the Stonewall
Diversity Champions Programme and will be submitting to the Workplace
Equality Index in 2021.

We hope that this information is of use. If you are dissatisfied with the
