As the Workplace Equality Index is a benchmark tool and a "developmental framework" which you use to measure your achievements and progress on LGBT equality, you will have assessed and reported on 10 areas of employment policy and practice, drafting answers and updating file information.
So I do not accept that you do not hold or have access to this information electronically and/or in final drafts prepared for submission, assessing and reporting on those 10 areas of employment policy and practice, and evidence submitted and/or have shared the finished submission with management and/or have links to the staff survey, references, attachments or appendices or other additional information & research for the submission.
Stonewall membership also includes also step-by-step guidance, review of your policies and introductions to other organisations.
I do not accept that you do not hold or have access to this information electronically and/or:
- final drafts for the Workplace Employment Index
- and/or have shared the finished submission with management
- and/or have links to references, attachments or appendices or other additional information & research for the submission
- and/or staff survey results
- and/or internal notes on feedback from the 2 hour feedback meeting
- and/or have policy advice from Stonewall on HR policies
and/or requests for lobbying action
So I do not accept that you do not hold communications from Stonewall including policy advice on HR policies from Stonewall and requests for lobbying action on the GRA and other matters.

In your internal review, you may decide Section 12 exemption applies. I direct your attention to your section 16 duty to provide me with advice and assistance to help me to refine my request. For example, it could make it possible for you to comply without incurring excessive costs by providing me with a list of the custodians (by job title; I do not need to know names) you believe to have been the recipients of such communications.
That, of course, would not exhaust your duty to provide me with advice and assistance as there may be other ways in which you can help me to refine my request so that it captures a representative picture of your dealings with Stonewall without exceeding the appropriate limit.

Our answer: -No drafts were created as the portal enables you to share
access and allow "collaborators" to review and amend information
provided. Access to the portal was not available at the time of your
previous request. However, the trust has now been able to get access and
therefore our 2019 workplace equality index submission is shared as part
of this response. As included in our first response the workplace
equality index did not take place in 2020 due to the COVID-19 pandemic.

Our answer: -There would have been others within the organisation who were
identified as "collaborators" to the index and would have been given
access to the portal to add or review information. 2019 workplace equality
index submission is included with this response.

Our answer: -This has been interpreted as requesting the supporting
information that some aspects of the Workplace Equality Index recommends.
This has been provided in our first response.

Our answer: -The trust did not participate in the staff survey element of
the Workplace Equality Index as the timing conflicts with the national NHS
Staff Survey. The trust is mandated to participate in the NHS Staff
Survey and decided not to undertake two surveys at the same time.
- and/or internal notes on feedback from the 2-hour feedback
meeting
Our answer: -The formal feedback report from Stonewall has been provided
to you in the first response. This was not a formally minuted trust
meeting and therefore there are no trust documents that can be disclosed.
Those who participated in the meeting may have taken additional "personal
notes" but these are not disclosable.
- and/or have policy advice from Stonewall on HR policies
Our answer: -Advice was obtained from Stonewall on the trust's Trans
Equality Policy in 2017. Advice was obtained from Stonewall on the
trust's Trans Patient Care Policy in 2018. Advice was obtained from
Stonewall on the trust's Leave & Pay for New & Existing Parents policy in
2018.
None of these were part of the 2019 or 2020 Workplace Equality Index
submission and therefore not provided in response to your first request.
-and/or requests for lobbying action
Our answer: -As previously responded, the only emails received on this
matter during 2019 and 2020 were part of generalised marketing mailing and
not specific to the trust.
-So I do not accept that you do not hold communications from
Stonewall including policy advice on HR policies from Stonewall and
requests for lobbying action on the GRA and other matters.
Our answer: -Your initial request was interpreted as being related to 2019
and 2020 Workplace Equality Index submissions hence why no information was
provided as none was available for this time frame.
