Information about the traffic regulation orders on Haddington St Car Park as part of the proposed St Andrews School expansion
Point 3.17 of the Report to the Children and Young People Committee of 17 November 2014 stated that a Traffic Regulation Order was not required for changes to the car park and that this could be dealt with through the planning process. The changes include temporary closure for approximately 6 months during construction work and the permanent reduction in public car spaces from 33 to 18. Please clarify the advice received in this matter, what planning powers you are relying on and why the existing Traffic Regulation Order does not need to be replaced or varied?

Advice on the TRO requirement was taken from officers in the Council’s transport and legal teams and this is reflected in paragraph 3.17 of the report.
A TRO is not required to reduce the number of car parking spaces in the Haddington Street off-street car park – this is because the number of spaces are not prescribed in the relevant traffic order and therefore a permanent reduction in the number of spaces does not trigger the need for an amendment to the Order. In addition a TRO is not needed to close/suspend the car park for a limited period of time – this is because the order itself provides that this can be done by way of a notice which will be organised if planning consent is granted.
The proposed physical changes to the car park are part of the planning application and will be considered in the determination of the planning application, as paragraph 3.17 notes.
Although planning legislation allows the council as Local Planning Authority to approve an appropriate amount of car parking spaces in a development this does not take the place of ensuring that any changes to public parking are also permitted under traffic legislation. A TRO is not needed because the provisions of the existing Traffic Regulation Order mean that one is not required.
