3. Details of meetings (date, location) held with representatives of the Thanet Business Forum between 2012 and present date. Include Thanet Regeneration Board, Destination Management Plan Steering Group and any other.

First, might I personally apologise for the delay in responding to your
outstanding case. As you may be aware we are, as a local district council,
incredibly tight on resources but, of course, this affords mere mitigation
and does not in any way excuse the need for a forthright apology in
failing to meet a statutory deadline: sorry.

 

I am, personally, new to this Council and in recent months TDC has
significantly increased its compliance with the statutory response
deadline for replying substantively to freedom of information requests.
We’ve worked very hard to deal with a number of legacy cases inherited
from a system which, evidently, did not work for you and others. Your case
is one of the last legacy cases this Council is obliged to respond to. We
apologise again. That response can, now, be provided from one of my
Officers. It follows, here:

 

The Freedom of Information Act 2000 provides a right only to information
held. It follows that only where that information requested is held can
we, as a public authority, move to respond to your questions under the
Act. This, of course, means that the response to you is, in this instance,
perhaps, neither complete nor exhaustive where, bearing in mind, the
information sought is not recorded. For the purposes of the Act, however,
TDC is in compliance when confirming and disclosing that which is “held”.
There is no other obligation for disclosure where it is not recorded.

 

I have responded to each of your requests for information, in turn:

 

[1] TDC does not hold the information requested under section 1(1)(a) of
the FOIA 2000.

 

[2] Communications with Maxim PR held by Thanet District Council have been
attached.

 

[3] Attached are all the meeting dates of the Thanet Business Forum that
the Council has attended (they do not all include a location as this
information is not held, nor minded for that matter). All the dates of the
Thanet Regeneration Board, Invest Thanet Board, Destination Management
Plan Steering Group and Destination Management Plan Consultative Group are
also included. We have also moved to disclose all the agendas we hold.

 

To help clarify why despite having undertaken extensive searches no
exhaustive information is in this regard held it might be worth noting
that there would be little need to hold and manage a central record
provided that, for one, say, a forum is just that: a forum. Such forums
hold no legal status but act as a discursive space; that is to say, it is
an institutional network with no legal decision making powers. You will,
for example, evidence yourself references in the minutes to decisions,
instead, for Thanet’s part, being referred to SMT/Cabinet etc. A forum
identifies issues and stratedgies for remedy but does not circumvent the
decision making process or due diligence here at Thanet District Council.
I would point you to para 6.2 of the Minutes to the Thanet Regeneration
Board dated 06 July 2012 in this regard. Some of the minutes, you will
see, also constitute drafts. These, too, are being disclosed as a gesture
of our sincerety in achieving transparency in this matter even where the
final versions, those which actually constitute the final and agreed
minutes, are not otherwise held by TDC.

 

You will note that there are redactions to the attached bundle. There are,
however, no redactions of any named TDC Officer. TDC considered the nature
of the information, the reasonable expectations of the data subjects and
the legitimate interests in disclosure. Section 40(2) provides that
information is exempt from disclosure if it constitutes the personal data
of a third party and its disclosure under the FOIA would breach any of the
data protection principles or section 10 of the Data Protection Act 1998.
Disclosure of the names, other than those from TDC, in this instance would
breach the first principle of the DPA 1998.

 

While this response is not to the extent you might otherwise have hoped,
we trust the explanations provided have, at least, proved helpful.

 

If you are unhappy with the way your enquiry has been dealt with, you may
ask for an internal review by submitting a request within one month of the
date of this response. Your request should be addressed to the Information
