Dear Care Quality Commission,
1. How many independent mental health facilities does the Care Quality Commission inspect?
2. How many of the independent mental health facilities that the Care Quality Commission inspects have failed to be inspected at the targeted frequencies (as outlined below)?
3. How many independent mental health facilities have reported incidents of ‘abuse’ or ‘serious misconduct or mismanagement’ (as defined by the CQC on their website) within the following time periods after receiving ‘good’ or ‘outstanding’ ratings by the Care Quality Commission:
a. 1 month after receiving a ‘good’ or ‘outstanding’ rating
b. 6 months after receiving a ‘good’ or ‘outstanding’ rating
Given that independent mental health services are inspected at different intervals depending on the facilities’ previous rating, my questions are based on the following criteria as stated on CQC website:
Rating at last inspection - Interval (years)
No prior inspection - Within one year of registry
Inadequate - One year
Requires Improvement - Two years
Good - Three and a half years
Outstanding - Five years

I acknowledge receipt of your correspondence dated 24 May 2019, in which
you made a request for information.
Your request is as follows:
“1. How many independent mental health facilities does the Care
Quality Commission inspect?
2. How many of the independent mental health facilities that the
Care Quality Commission inspects have failed to be inspected at the
targeted frequencies (as outlined below)?
3. How many independent mental health facilities have reported
incidents of ‘abuse’ or ‘serious misconduct or mismanagement’ (as defined
by the CQC on their website) within the following time periods after
receiving ‘good’ or ‘outstanding’ ratings by the Care Quality Commission:
a. 1 month after receiving a ‘good’ or ‘outstanding’ rating

CQC will consider your request in accordance with the Freedom of
Information Act 2000 (FOIA).
We are proceeding with your request but I wanted to make you aware that
section 8(1)(b) of FOIA requires that “the name of the applicant” must be
supplied to make a request legally valid. Whilst we will respond to your
request it is important that you understand that unless you provide us
with your full name, you will not have recourse to make a complaint to the
Information Commissioner’s Office (ICO) if you are unhappy with the
response that you receive from us.
Our statutory deadline for response is 24 June 2019, but we will in any
event endeavour to respond as soon as possible.
We will write to you if we are unable to meet this deadline.
The information you have requested may be subject to an exemption from the
right to know. Should this occur, we will explain the reasons why when we
respond.

We would seek the following clarification. As regards;
How many independent mental health facilities have reported incidents of
‘abuse’ or ‘serious misconduct or mismanagement’
There is no statutory notification of ‘serious misconduct or
mismanagement’
We are looking to provide data in line with your request in relation to 18-2e
Abuse or Allegation notifications as per Care Quality Commission (Registration)
Regulations 2009: Regulation 18. Please find below link.

incidents that affect their service or the people who use it. Below is a
