Dear Legal Aid Agency,

I am seeking the following information from the Legal Aid Agency (LAA) under the Freedom of Information Act 2000 (FOIA):

(1) A complete copy of the document entitled ‘ATP.PDF’, an excerpt from which was provided in response to my earlier request FOI/200617008 (the excerpt is available here: https://www.whatdotheyknow.com/request/6...).

(2) Information about the 'Interests of Justice Process Change' referred to in the document entitled ‘ATP.PDF’, mentioned above.

(3) Information about the LAA's investigations into how data science will be used to inform its approach to 'SCA/DV claims', referred to in the document entitled ‘ATP.PDF’, mentioned above.

(4) Information about the 'Means Function Form' referred to in the document entitled ‘ATP.PDF’, mentioned above.

In the event that you determine some of the information I have requested to be exempt from disclosure, please redact exempt information with black boxes, instead of snipping or excerpting, and please state which category of exemption you believe applies to the information.

If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in s.12 FOIA, please provide advice and assistance as to how I can refine my request, as required under s.16 FOIA.

Dear Legal Aid Agency,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Legal Aid Agency's (LAA) handling of my FOI request 'Information about Agency Transformation Programme'.

Specifically, I am seeking a review of the LAA's decision to withhold information 'because it would be likely to prejudice both our ability to ascertain whether any person has failed to comply with the law, as well as the commercial interests of any person'.

It appears that the LAA has withheld information on 'certain technical updates to the LAA's internal processes' and 'the LAA's methods of verifying compliance' with its rules and guidance.

The LAA justifies this decision on three grounds. First, it asserts that providing the information 'would leave the LAA more widely exposed to activities such as fraud via cyberattack'. Second, it asserts that providing the information 'may hamper its ability to detect and/or prevent misrepresentation'. Third, the LAA asserts that any need for transparency is satisfied by the publication of its operational processes, rules and guidance.

I am not satisfied with this justification. In relation to the first two grounds, it is unclear how disclosing the short excerpts redacted from the document provided would create any real risk of cyberattack or misrepresentation. The short excerpts would briefly describe work done on particular projects under the Agency Transformation Programme, rather than setting out the technical details of those projects or the LAA's security arrangements. It seems implausible to suggest that the disclosure of this information would create a risk of cyberattack or misrepresentation. In relation to the third ground, the LAA's publication of other materials does not satisfy the need for transparency, because it does not establish whether and to what extent the LAA's 'methods of verifying compliance' are consistent with those rules and lawful.
