Dear Blackpool Borough Council,

This request follows legal and mandatory legislation under the European Performance of Buildings Directive and specifically T.M44 AirConditioning Assesment certification. Your AirConditioning Assesment Certificates should be readily available at all times and be lodged on the government Landmark database. Failure to have appropriate Certificates will be subject to fines of £300 per building, each week.

Q. It is a legal requirement that you hold valid AirConditioning Assesments if any building has a total of more than 12kw of air conditioning present. Certificates are valid from 5 years of the issue date. Have you undertaken a T.M44 AirConditioning Assesment?
Q. Who is the responsible person for ensuring that your buildings are surveyed and assessed, please provide the name, address, email address and telephone number of the responsible person.
Q. If your T.M44 Certificates are in place, what is their expiry date?
Q. What was the order value of the works placed with the Company which undertook the work?
Q. Provide a breakdown of the price per building if available.
Q. How many Certificates were produced?
Q. Was the Assessor independent as required under the Regulations?
Q. Name the Assessor organisation.

I am writing to request an internal review of Blackpool Borough Council's handling of my FOI request 'Information'.

my freedom of information request is long over due. If you access the whatdotheyknow.com portal on the link below you can see just how overdue it is. This of course is against the statutory timescales as laid down by the act. I am surprised that this has occurred as your authority sent me an acknowledgement letter within the timescale and then the trail went cold.

Please can you review the processes involved and also provide my information in full.

ENVIRONMENTAL INFORMATION REGULATIONS 2004:  INFORMATION REQUEST
REPRESENTATION
 
Further to your correspondence regarding T.M444 assessments and
certificates, your request for review has been passed to me for
consideration.
 
As the information requested relates to structures or matters caught by
the definitions contained in Regulation 2 of the Environmental Information
Regulations 2004 (EIR), the Council has dealt with your request under
these regulations. I note that you were informed of this in our
correspondence of 28 August.
 
Throughout my response I have used the following abbreviations:
- EIR – Environmental Information Regulations 2004
- Reg/reg – Regulation (as contained within the Environmental Information
Regulations 2004)
 
In accordance with Reg 11 of the EIR, I have considered your
representation for review. As part of this process, we are required to
consider any supporting evidence supplied when making representations and
decide if we have complied with the Regulations. I have established the
following
 
In line with Reg 11(5), I have determined that we have failed to comply
with the requirements of the regulations on this occasion. The department
that responded initially does have procedures in place to track and
monitor their handling of information request. It is clear that on this
occasion these procedures failed and I would like to apologise on behalf
of the council. I have asked the department to take remedial action to
prevent this happening again.
 
To ensure compliance with Reg 11(5) I am obliged to inform you of any
actions and timescales. In terms of actions we will provide a response to
your questions and the timescale for this is immediately as our response
is shown against the questions you presented.

would be caught by the ‘over 12kw’ requirement to undertake an assessment
as you describe, for a T.M44 certificate.

Dear FOI,

Thank you for your response in light of the FOI request. However I believe your answer to be incorrect. Our database suggests the following buildings have a higher level of Air Conditioning over the 12kw threshold;

Blackpool Sports Centre
Palatine Leisure Centre
Moor Park Swimming Pool
Number One Bickerstaffe Square

In addition the following libraries are likely to feature air conditioning above 12kw.

Mereside Library
Poulton Library
Revoe Library
Blackpool Central Library
Layton Library
Anchorsholme Library
Bispham Library
Boundary Library
Palatine Library
Thornton Library

Can you please confirm. Given the size of the authorities estates it is surprising that no buildings qualify.
