This request follows legal and mandatory legislation under the European Performance of Buildings Directive and specifically T.M44 AirConditioning Assesment certification. Your AirConditioning Assesment Certificates should be readily available at all times and be lodged on the government Landmark database. Failure to have appropriate Certificates will be subject to fines of £300 per building, each week.

Q. It is a legal requirement that you hold valid AirConditioning Assesments if any building has a total of more than 12kw of air conditioning present. Certificates are valid from 5 years of the issue date. Have you undertaken a T.M44 AirConditioning Assesment?
Q. Who is the responsible person for ensuring that your buildings are surveyed and assessed, please provide the name, address, email address and telephone number of the responsible person.
Q. If your T.M44 Certificates are in place, what is their expiry date?
Q. What was the order value of the works placed with the Company which undertook the work?
Q. Provide a breakdown of the price per building if available.
Q. How many Certificates were produced?
Q. Was the Assessor independent as required under the Regulations?
Q. Name the Assessor organisation.
Q. Do you have ISO 14001 Accreditation

Thank you for your email. When we receive a request we open up a new box for that person/company as in our experience companies like yourselves come back time and time again and this saves the Trust valuable time, which is where I think this request went wrong, as it seems you changed the email address to that with a different number for the request, however the rest of the email address remained the same and this was missed.

You will note that we sent your response to the previous email box which has a slightly different number as follows:-

Received request dated 29th July 2014 at 17.38 pm
Sent acknowledgement on 30th July 2014 as the office had closed on 29th at 17.00
Response sent on 22nd August 2014 at 10.27 which is the 18th day of a 20 day statutory period

FOI's take up valuable resources within a hospital and like you we have tried to put in measures to reduce the time spent on these.

I have just returned from annual leave and have been informed that you wished to make a complaint regarding the fact that you did not receive a response to your recent FOI request. I see below that my colleague has resent this to you as attached and I would be grateful if you could confirm receipt.

Just to clarify the response would have been sent to the email address the request was received from, as I am sure you are aware we receive many requests from your organisation and this ensures that request and response marry up.

FOI's are extremely labour intensive for us but we try our best to ensure that these are dealt with promptly and within the statutory time limit, having to search for "old" requests that we have responded too only adds to this workload and delays the process further. For information if we are unable to respond within the 20 day time limit we make every effort to contact the requester and inform them of the reasons why.

I await your confirmation of receipt of our response.

Thank you for your response and provision of the information in full.

My request of an internal review was on the basis of the response being outside of the 20 day statutory period. I made my request on 30 July 2014, and I received a response on the 16th September 2014.

I think you might be confused as I am a private individual placing my request through whatdotheyknow online portal. I am sorry that you are busy but I felt a compliant was essential in getting this position reviewed. I would of been more inclined to wait had I received an acknowledgement.

Thank you for your email, I have just discussed this with my colleague Debbie Moores who co-ordinates all FOI's for the Trust.

After a review of this request I can confirm we received your request at 17.38 on 29th July 2014 and acknowledge receipt at 7.31 on 30th July 2014. A full response was sent at 10.27 on the 22nd August 2014. The 20 working day deadline was 27th August 2014, therefore we did not exceed the time limit.

I have taken the liberty of attaching a copy of these emails for your information. I am unsure why these were not received by you as they were delivered at our end, maybe there is a problem with the whatdotheyknow portal?
