Dear Pembrokeshire College,

This request follows legal and mandatory legislation under the European Performance of Buildings Directive and specifically TM44 Air Conditioning Assessments certification. Your Air Conditioning Assessments Certificates should be readily available at all times and be lodged on the government Landmark database. Failure to have appropriate Certificates will be subject to fines of £300 per building, each week.

Q. It is a legal requirement that you hold valid TM44 Air Conditioning Assessments if any building has a total of more than 12kw of air conditioning present. Certificates are valid from 5 years of the issue date. Have you undertaken a TM44 Air Conditioning Assessments?
Q. Who is the responsible person for ensuring that your buildings are surveyed and assessed, please provide the name, address, email address and telephone number of the responsible person.
Q. If your TM44 Air Conditioning Assessments Certificates are in place, what is their expiry date?
Q. What was the order value of the works placed with the Company which undertook the work?
Q. Provide a breakdown of the price per building if available.
Q. How many Certificates were produced?
Q. Was the Assessor independent as required under the Regulations?
Q. Name the Assessor organisation.

Thank you for your Freedom of Information Request . As you are aware the College is entitled to levy a reasonable charge to offset expenses and time . I will process your request on receipt of a cheque for £100 made payable to Pembrokeshire College .This will cover up to 90 minutes , if longer is needed you will be charged a further £100 per hour.

The freedom of Information Act 2000 expressly covers the fee's applicable to resourcing requests. Your authority would be able to levy fees on resourcing over £450.00 on a £25.00 per hour basis.

Given that you have stated resourcing far below this figure, can you please review and provide further comment.

Not withstanding the cost you will be aware that the disclosure of environmental environment is exempt under the Freedom of Information Act 2000 by virtue of section 39:environmental information

Section 39 exempts environmental information whose disclosure must be considered under the Environmental Information Regulations 2004; a specific regime to enable individuals to access environmental information , which includes its own exceptions from that right of access.

In response to question one - the College does hold a valid TM44 Air Conditioning Assessments and yes the College has undertaken a TM44 Air Conditioning Assessment.

In response to question 2 - The responsible Person is Steve Jones Head of Estates and facilities , he is contactable as [email address] and his direct line number is 01437 753208.

In response to question 3 - The expiry date of the TM44 Air Conditioning Certificates are the main campus 06/07 /2017 and the Mitec Campus 23/07/2017

In response to Question 4 - This is a matter of commercial confidentiality.

In response to Question 5 - Two certificates were produced

In response to question 6 - The Assessor was independent of the regulations

In response to question 7 - the Assessor organisation was Technical Building Solutions.
