This request follows legal and mandatory legislation under the European Performance of Buildings Directive and specifically TM44 Air Conditioning Assessments certification. Your Air Conditioning Assessments Certificates should be readily available at all times and be lodged on the government Landmark database. Failure to have appropriate Certificates will be subject to fines of £300 per building, each week.

Dear Ryan,
Thank you for your enquiry under the Freedom of Information Act. The
College has a Publication Scheme which promotes greater openness and
accountability. The publication scheme describes the information which we
publish, or intend to publish. In this context, 'publish' means to make
information available, routinely. The scheme is not a list of the actual
publications, because this will change as new material is published or
existing material revised. It is, however, our commitment to make
available the information described. We will endeavour to provide the
information requested and to do so within 20 working days.
Where the information can be collated easily, it will be provided without
charge. We do reserve the right to charge for time incurred in providing
information. This will be at a flat rate of £25 an hour, regardless of the
actual costs with an additional maximum fee of ten pence per photocopy.
There is no obligation to disclose information if the total costs
calculated in this fashion exceeds £450. Any such charge will be notified
in advance to the person making the request to check that they wish to
proceed; where possible alternative information or information sources
will be given. Where the work involved is excessive the college reserves
the right to decline to provide information requested. Where possible,
information will be made available on the college website where it can be
accessed free of charge.

Dear Mr Evans
Thank you for request for information regarding our air conditioning. Long
Road is a small Sixth Form College and has very little air conditioning in
its buildings.
Unfortunately we are not able to provide the requested information unless
the cost of dealing with the request has been met. We estimate this to be
£75.00. Upon receipt of your cheque made payable to Long Road Sixth Form

Dear Woolley, Gary,
The express provision of the Freedom of Information Act allows for a fee to be claimed when the request provision is over £450.00 on a £25.00 per hour basis.
Given that you have a legal responsibility to provide this documentation on request (specifically the ACIR certification) then this removes the resource (cost) factor out of the issue, more so given the size of your organisation.

We have not yet carried out a TM44 Assessment but we are aware of the potential need for possibly one or two buildings that require them. We have commissioned Constant Cooling of Sawston who maintain our system to appoint their assessor to carry out this work at Easter.
