Dear Frinton and Walton Town Council,

This request follows legal and mandatory legislation under the European Performance of Buildings Directive and specifically TM44 Air Conditioning Assessments certification. Your Air Conditioning Assessments Certificates should be readily available at all times and be lodged on the government Landmark database. Failure to have appropriate Certificates will be subject to fines of £300 per building, each week.

Q. It is a legal requirement that you hold valid TM44 Air Conditioning Assessments if any building has a total of more than 12kw of air conditioning present. Certificates are valid from 5 years of the issue date. Have you undertaken a TM44 Air Conditioning Assessments?
Q. Who is the responsible person for ensuring that your buildings are surveyed and assessed, please provide the name, address, email address and telephone number of the responsible person.
Q. If your TM44 Air Conditioning Assessments Certificates are in place, what is their expiry date?
Q. What was the order value of the works placed with the Company which undertook the work?
Q. Provide a breakdown of the price per building if available.
Q. How many Certificates were produced?
Q. Was the Assessor independent as required under the Regulations?
Q. Name the Assessor organisation.

Although I am really happy to this for you, I would like to know if you are a resident of our area as I do not recognise the name. if not I would be interested to know your reason for asking the questions and seeking the documents as some of the items you have requested could be a something that I would not disclose to another supplier. I am not sure who 'what do they know.com' is and therefore I need to make sure this is a legitimate request.

Dear Frinton and Walton Town Council,

Thank you for seeking additional clarity. This request is environmental, geo-political research prior to the next election. The enforcement of the legislation falls within this re-mitt. This is a national campaign.

The use of whatdotheyknow is a portal which facilitates these requests.

I would suggest you research the Freedom of Information Act as your authority is bound to the Act legally. Although I have offered some additional information as to the nature of the request, there is no legal requirement to justify this.

There is however exceptions to some questions which is expressly stated in the statute.

Dear Paul,

I do know the law and I have a BA Hons degree in local Government but we do get approaches from companies trying to get insider information on contracts to sell on to rival companies who then try to undercut our normal contractors and I need to satisfy myself that any enquiries of this sort do not fall into this category. We only manage1 building that falls into this category and we will send you the information that you require.

Perhaps you need to make people more aware of who you are when you approach them for this information saving both of us a lot of time. Especially when as a Council we are extremely busy at this time of the year doing all the Christmas extras that the Council gets involved in and having to fit in many extra meetings of the Council before their Christmas break.

The Town Clerk Mrs Myrna Lyles, has passed your email to me to respond
following your enquiry under the Freedom of Information act.

 

Frinton and Walton Town Council is a small Town Council.  Our Office is
located at: The Council House, Triangle Shopping Centre, Frinton on Sea,
Essex, CO13 0AU.  These premises are currently rented by the Town Council
from Tendring District Council who are the next tier of government in this
area.  There is no form of air conditioning in this building.

 

The Town Council of Frinton and Walton is responsible for The Columbine
Centre which is located at: Princes Esplanade, Walton-on-the-Naze, Essex,
CO14 8PZ.  There is no form of air conditioning in this building.
