I am writing to request an internal review of West London NHS Trust's handling of my FOI request 'Informal Patients'.
In response to my request for access to previous versions of the Trusts policy concerning Informal Patients, only three prior versions were disclosed. The Trust has stated that it does not hold the remaining six versions. The Trust has specific duties in terms of the proper Management of Records, which clearly are not being met with regard to its activities at Broadmoor Hospital. Additionally, It is quite reasonable to suggest that the Trusts statutory authorisation to provide high security psychiatric services at or from Broadmoor Hospital, Crowthorne, Berkshire RG45 7EG, implies a duty of both candour and good faith as it applies to operation of the Records Management Code of Practice and relevant Freedom of Information and Data Protection legislation enacted by Parliament.
The issue of Informal Patients in High Secure settings raises significant legal questions, and it is therefore perhaps convenient for the Trust that full transparency into these important matters is being withheld; attention must be drawn to the fact that the Trust initially denied that such a Policy existed and stated that Broadmoor does not treat informal patients. Obviously that was entirely incorrect.
Should the Trusts internal review into these important matters remain inadequate, then the Information Commissioner will be invited to conduct a thorough investigation into West London NHS Trust regarding this request, and more broadly into the Trusts informational duties under terms of the Act; with the Commissioner drawing any inferences from the above that he deems necessary and appropriate.

It has now been forty one working days since this request for Internal Review, against a decision to refuse access to information sought under the Freedom of Information Act 2000, was electronically communicated to and received by the Trust. Unfortunately no acknowledgment or reply has been issued. Ostensibly speaking, this may constitute an indefinite delay.
The request was made in accordance with the section 45 Code of Practice issued by the Secretary of State; which provides for an administrative remedy, by way of application of the dissatisfied applicant, requiring the Public Authority to carry out an internal review into its handling of the original request for information, which is to be conducted by someone more senior than the original decision-maker.
It would appear that, in the handling of this request, the Trust has failed to adhere to the relevant Advice and Guidance issued by the Information Commissioner's Office. A copy of the section 45 Code of Practice is attached at the bottom of this correspondence for your convenience.
Next Steps
The Application for Review inter alia it sought to establish whether or not the proper procedures are being followed by the Trust in relation to its informational duties. Obviously this is important, particularly given the nature of the Trusts public functions.
Consequently, I hereby again invite the Trust to fulfil its legal obligations under the terms of the Freedom of Information Act 2000.
Please be advised that the Commissioner has various powers of enforcement under the aforementioned Act of Parliament.
