Dear Mr Evans,

We write further to your email of 8^th January made under the terms of the
Freedom of Information Act 2000.

York Teaching Hospital NHS Foundation Trust is restricted in providing you
with the information you seek, namely information which has been received
from, or transferred to, the Officers of ‘The Infected Blood Inquiry’, by
virtue of the provisions of Section 32 of the Freedom of Information Act
2000.

In reaching this decision, the Trust is mindful that the unauthorised
disclosure of information, which has been placed in the custody of the
Inquiry or its Officers, can, in certain circumstances, constitute an
offence, particularly, but not exclusively, under the Inquiries Act 2005
and Inquiry Rules 2006.

 

However, in order comply with Section 16 of the Act, and to provide advice
and assistance, I can confirm that the Infected Blood Inquiry opened on 24
September 2018 and the requested information covers a period of 30 years.
Preliminary findings were completed in November 2018 and there are plans
to commence formal Public Hearings at the end of April 2019 with Public
Meetings in 18 different locations in the UK to enable affected people to
express their views

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of York Teaching Hospital NHS Foundation Trust's handling of my FOI request 'Infected Blood Inquiry Corr and Steps'.

In relation to Section 32(1)(a) and (b) and section 32(1)(c) under which you have perhaps applied exemptions. This is not applicable. This is because these provisions relate to Courts and Court proceedings, of which the Inquiry is neither. Further, the information is not held ONLY by this virtue.

You may find it helpful to know that the Inquiry recently published guidance which itself states that "An inquiry is not a trial and (unlike a trial) the role of the Chair is not to decide between rival cases".

An exemption under Section 32(2) would also not be applicable because the information is not held ONLY by this virtue.
