I am writing to request an internal review of Cardiff Council's handling of my FOI request 'Indoor arena full business case and associated documents'.
The response was due on 15 October 2021 and has still not been received.
Furthermore the papers requested are not exempt information of the description contained in paragraphs 14, 16 or 21 of Schedule 12A of the Local Government Act 1972.
The grounds for believing that some or all of these Appendices include information that is not exempt under paragraphs 14, 16 or 21 of Schedule 12A of the Local Government Act 1972 are:
1. Under paragraph 20 of Schedule 12A, information is not exempt information if it relates to proposed development for which the local planning authority may grant itself planning permission pursuant to regulation 3 of the Town and Country Planning General Regulations 1992. As Cardiff Council will be a Joint Applicant for a hybrid planning application for a mixed use masterplan within the Inner Harbour, Cardiff Bay that will include an arena, for which Cardiff Council will itself be the Local Planning Authority, information relating to that development is not exempt.
2. Information has been included in Confidential Appendices which is not exempt information of the description contained in paragraphs 14, 16 or 21 of Schedule 12A. For example, paragraph 69 of the Cabinet 23/09/2021 report ‘Indoor Arena Full Business Case’ states with regard to the Full Business Case contained in Appendix 2 that, in addition to the direct financial impact, the report also sets out the significant wider economic, social and environmental wellbeing benefits to the area of the new Arena. Such information is not exempt so should be in the public domain, in redacted copies of Confidential Appendices or otherwise.

I am writing to request an internal review of Cardiff Council's handling of my FOI request 'Indoor arena full business case and associated documents'.
As you may be aware, ICO guidance states that when applying a Section 43 exemption, an authority "must show that because [the information] is commercially sensitive, disclosure would be, or would be likely to be, prejudicial to the commercial activities of a person (an individual, a company, the public authority itself or any other legal entity)".
This response does not appear to have included such details, so I am requesting that you conduct an internal review, and, if the exemption is upheld, show how the release would be prejudicial to commercial activities, and of whom.
Furthermore, You have cited the likelihood of prejudice to a third party's commercial interests. As you may be aware, ICO guidance states "When a public authority wants to withhold information on the basis that to disclose the information would or would be likely to prejudice the commercial interests of a third party, it must have evidence that this does in fact represent the concerns of that third party. It is not sufficient for the public authority to speculate on the prejudice which may be caused to the third party by the disclosure."
Please review this decision, and, if the exemption is upheld, demonstrate stronger evidence that this disclosure 'would, or would be likely to' prejudice the concerns of the third party.
Furthermore, you have stated that the disclosure of this information would prejudice future negotiations. As you may be aware, ICO guidance on the Section 43 exemption says that this argument can only be applied if future transactions are likely to have a 'degree of similarity' with the information requested (https://ico.org.uk/media/for-organisatio...)
Furthermore, as you may be aware, ICO guidance on the Section 43 exemption states that: "It is [...] important for a public authority to consider each clause within a contract, rather than view the contract as a whole. Arguments about the burden this may create are not relevant under section 43". (https://ico.org.uk/media/for-organisatio...)
In the light of this, please release all parts of the contract to which Section 43 would not be relevant.
