Indicative Sanctions Guidance for Mentally Ill Doctors

Can panelists refer to any other guidance / rules when sentencing such doctors?
How many times have such rules not been followed by your Fitness to Practice panels (& there have been many digressions),

the Freedom of Information Act 2000 (FOIA).  

 

Section 8 FOIA states:

 

(1) In this Act any reference to a “request for information” is a
reference to such a request which—

 

    (a) is in writing,

    (b) states the name of the applicant and an address for
correspondence, and

    (c) describes the information requested

 

As can be seen above, s.1(b) requires that a request for information must
include the real name of the requester. The ICO’s guidance states that
under section 8(1)(b), if there is reason to believe the requester hasn’t
given their real name, a public authority can enquire about the
requester’s identity.

 

We are of the belief that S Ahmed is not your real name. If you wish to
proceed with this request, please contact us directly at [1][GMC request email]
to arrange providing evidence of your identity. Until we receive this,
your request will be regarded as invalid under the terms of the FOIA and
we will not respond to you further on this.
