Indemnity insurance: BEIS subsidy control advisory team
1. When the BEIS subsidy control advisory team offers advice to public authorities on how to comply with the subsidy control regime, what indemnity insurance does it have in place?
2. Please provide information about the process under which public authorities can file a claim against the BEIS subsidy control advisory team or its indemnity policy, if the BEIS advice turns out to be deficient or otherwise incorrect?
3. Is the written advice from BEIS on subsidy control regarded to always be outside the scope of the FOIA?
4. How is the BEIS subsidy control advisory team funded under the subsidy control regime?
The question is pertinent in light of the BEIS subsidy control advisory team being promoted as an alternative to consultants. This would imply the BEIS subsidy control advisory team operates in competition within the wording of paragraphs 651-652 of the draft Statutory guidance on the Subsidy Control Act 2022. Therefore more information on the funding arrangements would be beneficial.
