Indefinite leave to remain and English language requirement

Dear Home Office,

From October 28 2013, all applicants indefinite leave to remain are required to demonstrate their knowledge of the English language and of life in the UK.

Does "English language" requirement applies to a Tier 1(General) Main applicant who got the initial entry clearance on December 01 2008 and who has already proved the english requirement during inital Tier 1 application?

If it does, I would like to know the following:
1. why does the main applicant has to prove the English Requirement again when he has already proved it during the inital entry clearance and also at time to Tier 1 extension?

2. will you consider the IELTS test report (2008) which was accepted during the inital Tier 1 application? Please remember the IELTS test is valid only for 2 year.

Hi Amit

 

Migrants aged 18 to 64 must have sufficient knowledge of the English
language and life in the UK in order to qualify for Indefinite Leave to
Remain (ILR). Applicants in Tier 1 categories are required to show that
they meet the Knowledge of Language and Life in the UK requirement and
must do so by passing the Life in the UK Test.

 

·         If your English is already at or above ESOL (English for
speakers of other languages) Entry Level 3, you can take the test known as
the Life in the UK test.

·         If your English is below ESOL Entry Level 3, you will need to
attend an ESOL with citizenship course at an accredited college and obtain
a relevant ESOL qualification.

 

So if your existing skill in English language is above level 3, you may
proceed under point one above.
