Increased flood risk to Thames posed by Heathrow expansion

Please can you provide information on your involvement with Heathrow in understanding and mitigating the increased risk of flooding in the Thames valley as a result of the planned expansion of Heathrow - in particular in relation to areas downstream of Staines.

Please include: details of any associated studies or consultations you, or they, have undertaken (with website links);
Is the EA directly involved in the work Heathrow is undertaking regarding mitigating potential increased flooding in this area?
Who will decide if the plans they produce are adequate?
Does the EA have ultimate authority to make them change those plans if, in your opinion, they are inadequate?

Dear Susan

 

Thank you for your enquiry of 04 March 2019 regarding a potential increase
in risk of flooding to the Thames posed by the Heathrow expansion.

 

We respond to requests under the Freedom of Information Act 2000 and
Environmental Information Regulations 2004.

 

Please refer to [1]Open Government Licence which explains the permitted
use of this information.

 

We are a prescribed body/consultee under the 2008 Planning Act and must be
consulted at prescribed times under the legislation. The final decision on
whether to grant consent lies with the Secretary of State. We will advise
the Secretary of State on the flood risk associated with the proposals for
expanding Heathrow Airport. Other organisations will also provide such
advice. We will remain a regulator of certain activities under the
environmental permitting regulations if the scheme is granted consent.

 

We have been in discussions with Heathrow Airport Limited about their
plans and expect to review and respond to their preferred proposal when
this gets released for consultation in June.  Any further information
regarding the consultation will be available at

Arora Ltd have not consulted us with regard to their proposal. 

 

We have not carried out any associated studies or consultations.

 

You may wish to contact Heathrow Airport Ltd or Arora Ltd directly to
request any relevant information from them.

 

EIR Regulation 3(2) states that information is held if it is in our
possession and has been produced or received by us, or it is held by
another person on our behalf at the time the request is received. In this
case, the information you have requested is not held by the Environment
Agency, and we are therefore refusing your request on the grounds that
there is no information we can provide.

 

Where a request is for environmental information, the Regulations allow us
to refuse to disclose it if the exception at EIR Regulation 12(4)(a)
applies. The regulation states that a public authority may refuse to
disclose environmental information to the extent that it does not hold
that information when an applicant’s request is received.

 

It is not possible for us to conduct a public interest balancing test
because the reason for non-disclosure is that the information is not held.
