Inappropriate Access of Records/Porn

Dear Department for Work and Pensions,

The Telegraph reports that in a recent freedom of information (FOI) request, a total of 1,100 DWP employees have received verbal warnings in the past five years for "inappropriate access or browsing of personal/customer records". In addition to the verbal warnings, 422 staff received written warnings and 585 received final written warnings with hundreds of employees warned about how they used the web, including cautions for sending inappropriate emails and accessing pornographic content.

Could you provide the related figures for Atos employees in the past five years and the disciplinary procedures taken with regards to

a) inappropriate access or browsing of personal/customer records
b) inappropriate use of the web,
c) sending of inappropriate emails and accessing pornographic content.

Surely Atos will have the figures and as they are carrying out a public service I suggest that Atos should provide the information you requested. It might be worth an IRR and a complaint to the Information Commissioner.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Inappropriate Access of Records/Porn'.

In answer to my FOI request your reply was …."As ATOS staff are not directly employed by DWP, I can confirm that we do not have the figures you are requesting relating disciplinary procedures taken against ATOS staff".

Claimants are required by the DWP to provide Atos with personal and sensitive information and Atos are employed by the DWP for this reason. The DWP have a duty to ensure that this information is safe. If you are not aware of the figures as requested in the FOI request then such safeguards can not be achieved. If you do not hold the information then you are required to access it from the people you employ. Please provide the information as requested.

With regards to your response to my request for an Internal Review you state that …

"In this instance you did not limit your request to information in respect of ATOS employees working on contracts awarded by the Department for Work and Pensions (DWP)".

In order to satisfy the requirements mentioned above I will rephrase the question. Further to other aspects of your response I would contest that ATOS with regards to the contractual work undertaken on behalf of the DWP is by definition a public authority. However, my amended FOI request is as follows ..

Please provide the figures for Atos employees working on contracts awarded by the Department for Work and Pensions (DWP) in the past five years and the disciplinary procedures taken with regards to

a) inappropriate access or browsing of personal/customer records
b) inappropriate use of the web,
c) sending of inappropriate emails and accessing pornographic
