dvd.

Thank you for your e-mail received on 30 August 2016 asking for a copy of
the In the Zone DVD.
Your request has been considered in accordance with the requirements of
the Freedom of Information Act and our information access policy. I can
confirm we do hold the information you require.
A copy of the ‘In the Zone’ DVD can be sent to you in the post once we
receive your postal address. Please send it to [1][email address].
Please note that the Sarah Hope clips referred to in the presentation on
the DVD will be withheld under section 40(2) and 41of the FOI Act.
Section 40(2) has been applied as disclosure of this personal data would
be a breach of the DPA, specifically the first principle of the DPA which
requires all processing of personal data to be fair and lawful. It would
not be fair to disclose the personal information contained in the clips
when the individuals have no expectation it would be disclosed and TfL has
not satisfied one of the conditions of Schedule 2 of the Data Protection
Act which would make the processing ‘fair’.
Section 41 has been applied as the films were made under an explicit
understanding that they would only be used for training purposes and not
shared with a wider audience.
Both of these exemptions are absolute exemptions, therefore we have not
gone on to consider the balance of the public interest. However, even if
section 41 did not confer absolute exemption, there would be no special
public interest in disclosure of this information that would justify a
breach of confidence in this case.
