Superintendent Pharmacist:

Dear Mr Gurney

Thank you for contacting us again and further to your request for a copy
of the Tesco Crisis Management Plan which we handled under the Freedom of
Information Act (FOIA) 2005.

Although referenced in the documents already provided to you under your
initial FOIA request, the Crisis Management Plan is not a document used by
our pharmacy business, it therefore sits outside of the scope of FOIA.
Your request is unfortunately refused and given the scope of the FOIA we
are unable to offer any advice, on this occasion, as to how you could
modify your request to fit within FOIA requirements.

Once again thank you for your request, if you have a complaint about how
we handled your request you may ask for an internal review by writing with
details to: Senior Counsel (Data Protection), Tesco Stores Limited, Maldon
Building, Shire Park, Welwyn Garden City, AL7 1GA. We will respond to your
complaint within 20 working days. If you remain dissatisfied with how we

I would like to contest Adrian's statement in which he says that the "Crisis Management Plan is not used by our pharmacy business" on the grounds that it is referenced to be used by pharmacies in-store alongside the Pharmacy-specific Business Continuity Plan. This is per the following: "Use the plan in conjunction with the Crisis Management Plan (not supplied already in store)."

As such, I would ask that you reconsider the later request for a copy of Tesco's Crisis Management Plan.

I've received the following response from Adrain Price, our Superintendent
Pharmacist;

"Dear Mr Gurney

Thank you for your response and your request that we reconsider supplying
the Crisis Management Plan.

Whilst the phrasing in the Pharmacy BCP could be interpreted in a way that
suggests the pharmacy may use or have to use this document. The reality of
how this document is used is different and it is only used by colleagues
from the wider retail business. The Crisis Management Plan is not a plan
or document used by our pharmacy business and therefore not subject to
FOI. In reconsidering your request we therefore still have to refuse the
request and cannot offer recommendations as to how you could amend your
request in these circumstance.

Once again thank you for your request, if you have a complaint about how
we handled your request you may ask for an internal review by writing with
