Dear Merthyr Tydfil Council,

I wish to make a Freedom of Information request in relation to the Operation of the Council and its Members.

1. Can you please confirm the numbers of complaints made against Councillors that you have received between the period May 1st 2012 to 11th January 2021.

2. Can you provide a breakdown of all such complaints received, by individual Councillor. You may consider redaction, but I would respectfully point out, that redaction should not be necessary, as Councillors are Elected Representatives and, as such, any complaints should be in the Public Domain and not subject to any redaction.

3. Can you please outline and provide me with details of how such complaints are handled and dealt with, either by Policy or Procedure.

4. On receipt of a complaint, can you provide me with a framework for dealing with such complaints, how, for example, is the complaint assessed, who makes the decision of any threshold point, what is the criteria for such complaints, including details about the process of how such complaints are escalated; to Group Leaders, Standards Committee, Ombudsman etc.

5. Can you provide details, preferably by providing a blank template, of how the decision making process around Councillor complaints is dealt with, the progress of a complaint, where is it recorded and where would such a record be held and for what duration, outlining the GDPR Principles that may apply around this process.

6. Could you outline what initial training and ongoing advice and development is provided to, and for, Elected Members to enable them to understand their role and, more specifically, around matters of personal and prejudicial interests.

7. Can you provide specific details, including any Job Description and Personal Specification, of the Chair and Members of the Councils Standards Committee.

8. Can you outline the process, or procedure, for recruiting any vacancies to the Standards Committee, including the process for shortlisting and the interview of prospective candidates. Are such appointments, subject to confirmation, if so, by whom, and are such appointments subject to recommendation and or approval by the Cabinet or full Council. As such, can you please confirm and provide any details of any Welsh Government Guidance, or Regulation, on such matters, particularly, on the appointment of co-opted Members and any members, other than Elected Members, to any Council Committee.

9. Can you please furnish me with specific details of to whom complaints about Councillors are reported and furnish evidence of any said reporting to the said body, or Committee, since the 1st May 2012 to the 11th January 2021.

cannot supply the information you have requested. In accordance with

Thank you for your response to my FOI Request. I would refer you to today's telephone conversation with a gentleman named 'Sam' and, as per his advice, I wish to amend the time criteria of my request to two years, not the original time scale as in my original FOI Request.

1. Can you please confirm the numbers of complaints made against
Councillors that you have received between the period May 1st 2012 to 11th
January 2021. I have accessed information back to the beginning of 2017
and there have been 28 complaints against Councillors in that time

 

2. Can you provide a breakdown of all such complaints received, by
individual Councillor. You may consider redaction, but I would
respectfully point out, that redaction should not be necessary, as
Councillors are Elected Representatives and, as such, any complaints
should be in the Public Domain and not subject to any redaction.

As some of the complaints were not upheld and seem to have been malicious
it would not be appropriate to share the details but I can advise that 21
complaints were against members of the Independent Group, 6 were against
members of the Labour Group and one against a member who at that point was
not affiliated to a political group

3. Can you please outline and provide me with details of how such
complaints are handled and dealt with, either by Policy or Procedure.
Complaints are either dealt with by me as part of the informal resolution
procedure, by Standards Committee of by referral to the Ombudsman

 

4. On receipt of a complaint, can you provide me with a framework for
dealing with such complaints, how, for example, is the complaint assessed,
who makes the decision of any threshold point, what is the criteria for
such complaints, including details about the process of how such
complaints are escalated; to Group Leaders, Standards Committee, Ombudsman
etc. Complaints against members come to me as Monitoring Officer or to the
Ombudsman. I evaluate whether those that come to me are suitable for
informal resolution and will try and resolve in that way if possible. If
they cannot be resolved in that way I will refer on to Standards Committee
for hearing or to the Ombudsman depending on the nature of the complaint.
If the complaint is made directly to the Ombudsman he will either allocate
to an officer to be investigated or reject the complaint as not
demonstrating a breach of the Code of Conduct. If Investigated by him he
can either determine it himself, refer back to the Standards Committee or
refer to the Adjudication Panel for Wales for hearing.

 

5. Can you provide details, preferably by providing a blank template, of
how the decision making process around Councillor complaints is dealt
with,  the progress of a complaint, where is it recorded and where would
such a record be held and for what duration, outlining the GDPR Principles
that may apply around this process. It is my role as Monitoring Officer to
determine how the complaint will be dealt with and to keep a record of
those complaints. I do that by considering the substance of the complaint
and whether it appears to be a potential breach of the Code of Conduct

 

6. Could you outline what initial training and ongoing advice and
development is provided to, and for, Elected Members to enable them to
understand their role and, more specifically, around matters of personal
and prejudicial interests. All Councillors have to undertake mandatory
Code of Conduct Training before they sign the declaration of office. After
that they have access to advice from me as Monitoring Officer and from
Democratic Services staff at any time. Democratic Services staff compile
training needs analysis information and access and deliver training as and
when required

 

7. Can you provide specific details, including any Job Description and
Personal Specification, of the Chair and Members of the Councils Standards
Committee.

JOB DESCRIPTION

for

INDEPENDENT MEMBER OF STANDARDS COMMITTEE

 

N.B.  The person appointed my need to be able to act as Chair / Vice Chair
(if appointed by the committee).  An inability to attend meetings
regularly would necessitate a review of the appointment.

 

 

JOB PURPOSE

To sit as a member of the Council’s Standards Committee.  To act as Chair
/ Vice Chair (if appointed)

 

 

PRINCIPAL RESPONSIBILITIES

 

·                Promote and maintain high standards of conduct by
Councillors, co-opted members and church and parent governor
representatives;

 

·                Assist the Councillors, co-opted members and church and
parent governor representatives to observe the Members’ Code of Conduct
and associated local protocols;

 

·                Advise the Council on the adoption or revision of the
Members’ Code of Conduct and associated local protocols;

 

·                Monitoring and review the operation of the Members’ Code
of Conduct and associated local protocols;

 

·                Develop for recommendation to the Council local protocols
to supplement the Members’ Code of Conduct;

 

·                Enforce local protocols and apply sanctions in respect of
breaches as appropriate;

 

·                Advise, train or arrange to train Councillors, co-opted
members and church and parent governor representatives on matters relating
to the Members’ Code of Conduct and associated local protocols;

 

·                Grant dispensations to Councillors, co-opted members and
church and parent governor representatives from requirements relating to
interests set out in the Members’ Code of Conduct and associated local
protocols;

 

·                Deal with any reports from a case tribunal or interim
case tribunal, and any report from the Monitoring Officer on any matter
which is referred to that officer by the Local Commissioner for
Administration in Wales (Ombudsman);

 

·                Keep under review, amend and make additional provisions
to the Protocol on Member/Officer relations;

 

·                Monitor the Officers’ Code of Conduct to ensure
consistent application and enforcement Council-wide;

 

·                Oversee the general overview of probity matters arising
from the Local Commissioner for Administration in Wales (Ombudsman)
reports, Monitoring Officer reports and Audit reports;

 

·                Exercise all of the above in relation to the Community
Council wholly or mainly in its area and the members of the Community
