The Information Commissioner’s Office contacted NHS West Lancashire
Clinical Commissioning Group  in connection with a  complaint received
about the failure of NHS West Lancashire Clinical Commissioning Group to
respond to your information request under the Freedom of Information Act
2000 (FOIA) dated 15 August 2018 via the whatdotheyknow.com website

We have investigated why the FOI request  from whatdotheyknow.com website
was not received and it transpires that they have been using an out of
date email address to forward FOI requests to NHS West Lancashire Clinical
Commissioning Group.  This has now been resolved and we have kept the
ICO/caseworker copied fully informed of this issue.

 

In response to your FOI request in the link above “Could you please send
me the latest 3 copies of your IM&T meeting (or equivalent) minutes and
agenda”

 

NHS West Lancashire Clinical Commissioning Group do not hold this
information as the CCG commission IM&T services from NHS Midlands and
Lancashire Commissioning Support Unit.

 

I have copied in this response to the ICO caseworker at their request (see
attached).

WhatDoTheyKnow has provided evidence to the Information Commissioner demonstrating the request was delivered, and accepted by the CCG.

We consider the evidence we have provided to be better than both "proof of posting" and the level of assurance of delivery one would obtain sending a "signed for" physical letter.

The CCG does appear to regularly change its preferred FOI contact email and does not emit error messages / bounce messages or autoresponses on addresses it has previously advertised but decided to cease to read/use. We have asked the Information Commissioner to consider this practice (which we don't consider to be good practice!) when making a decision in this case.

That said it would have been useful if our users had alerted us to the problems contacting this CCG earlier; we could have taken steps to re-send messages and try to get the CCG to respond to them sooner.
