Implementation of new domestic violence bill august 2020
Dear Home Office,
Under the FOIA , I would like to know regarding the new domestic violence bill of 2020 and it's implementation into family courts and the justice system of England & Wales.
In cases where previously there is evidence of domestic violence as recorded by authorities, involving two custodial parents, who are fighting for custody & access rights to their children, in the family courts, but the family courts did not take steps to provide protection for the victim in court or during the course of the procedures and also enabled the abuse to continue via the repeated bringing back of the victim to court, without making any barring orders, and therefore concluded that there was no domestic violence and refuted the victims claim to being a victim of DV.
Under the new law, if family court proceedings were to start again for the same case, would the family court have to change their actions or decisions in court , towards the victim, or reconsider the evidences in the case concerning domestic violence OR would they continue to treat the case with the same judgement, based on bias or past case history, and disregard this new bill which holds them accountable for change under the new domestic violence bill 2020.
