Impact assessments - Mental Capacity (Amendment) Bill

Dear Department of Health and Social Care,

I am seeking some further information about the projected impact of the Mental Capacity (Amendment) Bill than that which is provided in the published impact assessment (dated 29/06/2018).

Please could you provide me with any estimates the DHSC has produced or obtained of the number of people who may be detainable under the Mental Capacity (Amendment) Bill on grounds of 'risk to others'. Please could you provide information such as policy documents, minutes of meetings, correspondence, detailing how the DHSC has sought to obtain such estimates (for example, through consultation with health and social care professionals or providers).

Please could you also provide me with any impact assessments the DHSC has produced for the cost of assessments being arranged by the responsible body, rather than care home managers, in care homes. The published impact assessment provides only estimates for the cost of these assessments being conducted by care home managers, and not the alternative policy choice of their being arranged by the responsible body.

I wanted to follow up on my request for information about estimates of the cost of transferring responsibility for assessments to the responsible body, and estimates of the number of people who might fall into the 'risk to others' category. I have not received an acknowledgement yet, and just wanted to clarify that when I withdrew my earlier request for information about the Mental Capacity (Amendment) Bill documents, because they were now online, I was not withdrawing this request. I apologise for any confusion this may have caused.
