Dear Legal Aid Agency,

For the last 12 months, please provide the following:

1. The number of Judicial Review cases, in which legal aid was granted by the Legal Aid Agency or its predecessor (LAA), where the claim related to alleged delays in the Home Office implementing immigration status following a successful appeal before the Immigration and Asylum Chamber (First-tier Tribunal or Upper Tribunal).

2. A list of all such cases setting out the value of legal costs ultimately paid out by the LAA for each.

Thank you for your email of 19^th November 2013, in which you asked for
the following information from the Legal Aid Agency (LAA) an Executive
Agency of the Ministry of Justice (MoJ):

 

"For the last 12 months, please provide the following:

Your request is being handled under the Freedom of Information Act 2000
(FOIA).

 

Under the Act, the department is required to provide you with a response
within 20 working days. We will write to you in response to your request
for information by 17^th December 2013.

 

The Freedom of Information Act includes a number of exemptions to
releasing information.  Some of these are qualified exemptions which
require us to consider whether it is in the public interest to disclose or
withhold the information.  In these circumstances we may need more time to
consider your request, and if this is the case I will write to you by the
date above to inform you of when you can expect to receive a
response.

Dear Legal Aid Agency,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Legal Aid Agency's handling of my FOI request 'Immigration Judicial Reviews - Failure or Delay in Implementing Allowed Immigration Appeals'.

I note the content of the reply provided by the Legal Aid Agency, but I cannot believe that the LAA does not hold information on the types of case for which funding is awarded or, in particular, the type of claim to which my request related.

If that is true, the LAA would have no way of knowing whether or not funding is being awarded in appropriate cases. In essence, it would have no means of monitoring performance or value for money for the taxpayer. This cannot be right; they must hold some relevant information here and for all of the above reasons I respectfully ask for an internal review.
