ILR continuous absence calculation (180 days) for 10 year long residency

Response to this request is long overdue. By law, under all circumstances, Home Office should have responded by now (details). You can complain by requesting an internal review.

Dear Home Office,

My question is regarding the ILR continuous absence calculation for 10 year long residency. According to the guidelines you mention 6 months is the cut off point for continuous absences from the UK and you further clarify this in the guidelines by stating 180 days. I figured that you work on a 30 day average calendar month (180/6 =30 or 356/12 =30.41). Is this correct?

I just want to clarify. If one left the country on the 30 March (March has 31 days) and entered on the 1 Oct this person should still be within the 6 month cut off point right? Because you consider a 30 day calendar month which means you disregard the 31 of every month. My observation is no continuous six months add up to 180 days. Please advise. Can you also show me where this calculation is made in the policy as I can’t seem to find it.

Yours faithfully,

Rebecca
