ILR Authorized -Unpaid leave
Dear Home Office,
Could you please confirm my below understanding of ILR guidelines:
"323AA Prohibited changes to employment for Tier 2 Migrants and Tier 5 Migrants
The following are prohibited changes, unless a further application for leave to remain is granted which expressly permits the changes:
(a) The migrant is absent from work without pay for four weeks or more in total, according to his/her normal working pattern (whether over a single period or more than one period), during any calendar year (1 January to 31 December)"
1. I understand that as per immigration guidelines above, Authorized Unpaid leave up to 4 weeks does not break the continuous residence for ILR through Tier 2 general route. Is my understanding correct ?
2. Do we need to submit any letter from employer for unpaid absences ( I have unpaid absence for 18 calender days ?
3. Since i took unpaid leave with my previous employer, I am not able to secure letter for my unpaid absences. But I manage to get email approval from my previous company supervisor to authorize my leave. He sent an email approval to HR dept to issue me a letter. But HR dept is not issuing the letter. In this case does that email approval is enough to prove as a evidence ?
