I am making a request for all the information to which I am entitled to under the Freedom of Information Act, concerning:-

1. Between 2003 -2014, how many incidents have been recorded by Gwent Police, of:-

a) Police Officers / Staff illegally accessed personal / medical records of a member of the public, which are held by the NHS / local health boards?

b) Local Authority / Council Staff / Officers illegally accessed personal / medical records of a member of the public, which are held by the NHS / local health boards?

c) NHS Staff illegally accessed personal / medical records of a member of the public, which are held by the NHS / local health boards?

2. Between 2003 -2014, how many incidents have been investigated by Gwent Police of:-

a) Police Officers / Staff illegally accessed personal / medical records of a member of the public, which are held by the NHS / local health boards?

b) Local Authority / Council Staff / Officers illegally accessed personal / medical records of a member of the public, which are held by the NHS / local health boards?

c) NHS Staff illegally accessed personal / medical records of a member of the public, which are held by the NHS / local health boards?

3. If investigations took place (relating to question 2.) of the illegal accessing of personal / medical records of a member of the public, which are held by the NHS / local health boards. Which department(s) within Gwent Police investigated, relating to:-

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities.  Unless exemptions apply, the first duty at,

One of the reasons why I made the above Freedom of Information Request to Gwent Police is as follows:-

My family made Subject Access Requests to the Aneurin Bevan Health Board (ABHB) concerning who had been accessing our health records.

The ABHB eventually provided the lists that exposed there have been considerable amount of individuals that have been accessing our personal / medical health records, yet they did not have the legal right to access our records.

As the illegal accesses were not individual cases, we approached the Health Inspectorate Wales (HIW).

The HIW claims:-

•We take immediate action if we determine that the safety and quality of healthcare does not meet required standards, etc.

Yet, the HIW’s response to our complaints of illegal accessing of our medical records (These illegal accesses spanned over a considerable amount of years, which involved Torfaen Council, the NHS and Police) was:-

HIW spoke with a Detective Sergeant in Gwent Police. The HIW shared with the DS that the HIW had received concerns about illegal access of medical records within Aneurin Bevan Health Board and sought advice on whether this would be viewed as a criminal matter by the police and necessitate investigation by them.

The HIW then stated that:- “…..the Police has jurisdiction of HIW on certain criminal matters and it would be for the Police to take appropriate action before HIW could become involved.”

The HIW subsequently would not pursue the complaints further.

The criminal matters were reported to the Chief Constable of Gwent Police Jeff Farrar, via the Police & Crime Commissioner, Ian Johnston.

To the date of this posting, 3 Nov 2014, almost 4 months have passed, since the crimes were reported to the police and no indication has been provided by the police that they are investigating the criminal acts committed against my family.

Hence, the reasons why I have started to submit Freedom of Information requests to ascertain how many complaints of this kind have been officially recorded by the police.

Dear Ms Williams

It has come to my attention that you may be acting in concert with other
parties as part of a campaign to attempt to cause a disproportionate or
unjustified level of disruption, irritation or distress to the authority.
Gwent Police has received another request relating to a similar subject
area, and we believe you may be connected in some way.

The Freedom of Information Act is a piece of legislation which quite
rightly opens up public authorities to greater scrutiny and
accountability.

Under the provision of the Act an authority must process a request in
writing from a named applicant under the terms and conditions of the
legislation. Whilst giving maximum support to individuals genuinely
seeking to exercise the right to know, the Commissioner's general approach
will be sympathetic towards authorities where requests can be
characterised as being part of a campaign.

Section 14(1) is designed to protect public authorities by allowing them
to refuse any requests which have the potential to cause a
disproportionate or unjustified level of disruption, irritation or
distress.

 

Therefore with regard to this request we are including a warning under
Section 14(1)(Vexatious Request) of the Freedom of Information Act that
any future requests may attract this exemption.

In order to avoid attracting this exemption, I will require you to provide
some form of identification to enable me to establish that you are who you
say you are before I can process your request any further.

Acceptable identification could be a driving licence, utility bill or
something similar that establishes your full name and address.

A scanned copy sent to the below email address would be acceptable or in
person at a police station. If you decide to produce it personally at a
police station you will need to take a copy of this email with you so that
the officer that records your details will be aware that they will need to
forward it immediately to the below email address:
