I am writing to request an internal review of The Local Government and Social Care Ombudsman's handling of my FOI request 'If you pay late on more than two occasions the right to pay by instalments is lost'.

Thank you for your reply of 14 September 2017.

You stated:

"Because all parties to an Ombudsman investigation – including ourselves – are required by law to keep the investigation private, this is not something we can respond to under the provisions of the Freedom of Information Act, because the information is not provided in the decision statement itself.

The information you have requested would be included in the contents of a complaints file. Although the public do have rights to see information held by public bodies under the Freedom of Information Act, this Act (section 44(1)(a)) does not override any restriction on the release of information covered by an earlier law. Such a restriction applies to the Ombudsman’s complaint files. Under the Local Government Act 1974 (section 32(2) or 34(K)(1)), the Ombudsman is not permitted to disclose any information obtained in the course of, or for the purposes of, the investigation of a complaint, unless he considers it is necessary for the purposes of the investigation (or for other very limited reasons mostly related to legal proceedings).

Releasing this information to you is not necessary for the purposes of the investigation and so I am not able to comply with your request."

The information I have requested may well be included in the contents of a complaints file but by virtue of the LGO including it in a complaints file it must also be held by the LGO outside the contents of a complaints file.

My request therefore is asking for the information held by the LGO outside the contents of a complaints file.

Dear Trish Farman,

Thank you for the references etc. So in actual fact a Council can demand the full amount which is due for the rest of the year if the taxpayer fails to pay on only one occasion in some circumstances.
