1. the number of failures each month to meet the performance standard required by the service performance indicators in Appendix A of Schedule 1 of the contract broken down by the service performance indicators which have not been met

2. the number and details of any deductions made for each month since the start of the contract broken down by the service performance indicators which have not been met

3. the number and details of occasions each month when idverde has used a rectification period to address any failures in performance broken down by the service performance indicators which have not been met

4. a copy of each of the Annual Reports provided by idverde under Section 6 of Schedule 6 of the contract

5. a copy of the performance section of each of the Monthly Reports provided by idverde under Section 5.1(a)(i) of Schedule 6 of the contract since it began

6. a copy of any contract amendments since the start of the contract

We have now considered your information request as set out below.

 

Please accept our apologies for the delay in providing this information.
The nature of the request required that we consult with the South London
Waste Partnership team and our local authority partners in compiling this
response.

 

You asked various questions, the responses to which are provided below by
each in turn:

1.    The number of failures each month to meet the performance standard
required by the service performance indicators in Appendix A of Schedule 1
of the contract broken down by the service performance indicators which
have not been met.

2.    The number and details of any deductions made for each month since
the start of the contract broken down by the service performance
indicators which have not been met.

Merton Council is currently in discussions with idverde regarding the
issues of deductions. As such this information is considered exempt from
disclosure under Sections 43(2) and 42 (commercially sensitive and legal
professional privilege).

 

Disclosure of this information would be likely to prejudice the council’s
commercial interests, as it could be considered a breach of confidence
resulting in a loss of trust which could affect existing and future
contracts/tenders. The information, if released, may also harm Merton’s
ongoing negotiations in regards to the provision of the existing contract.

 

The information requested is also considered exempt under section 42 as it
is subject to ongoing legal discussions and its release may harm this
exchange. As any deductions would be subject to legal approval and as such
covered by lawyer client privilege.

 

As sections 42 and 43(2) are qualified exemptions, we have gone on to
consider the public interest test. We accept that there is a general
public interest in openness and transparency to promote accountability. In
this case the public interest in maintaining the exemption outweighs the
public interest in disclosing the information. 

3.    The number and details of occasions each month when idverde has used
a rectification period to address any failures in performance broken down
by the service performance indicators which have not been met.

This data is not held by the local authority.

4.    A copy of each of the Annual Reports provided by idverde under
Section 6 of Schedule 6 of the contract.

The first annual contract report for the period February 2017 to March
2018 has not yet been formally agreed by all parties and is therefore not
currently available. The second annual report is not due until the spring
of 2019.

5.    A copy of the performance section of each of the Monthly Reports
provided by idverde under Section 5.1(a)(i) of Schedule 6 of the contract
since it began.

Copies of the relevant sections from the submitted reports are attached.

6.    A copy of any contract amendments since the start of the contract.

There have been no formal amendments to the contract since its
commencement.
