Dear UK Border Agency,

Further to my previous request (which i note you cancelled...) UKBA has a reference to Zambrano in the following guidance...

http://www.ukba.homeoffice.gov.uk/siteco...

I note that section 3.2.7b states the following:
'Where caseworkers consider there may be a Zambrano right they should refer to the following guidance which sets out how Zambrano and the Article 8 ECHR right to private and family life interact:
*Link to internal guidance removed*'

FOI Request: Can I either have a link to the guidance in the public domain (which i cannot obviously find, as I dont see any reference to what guidance it refers to), or can you provide me with the guidance referenced in this file...

Yours faithfully,

Wayne Pearsall

Dear European Operational Policy Enquiries,

Further to 27354, can you confirm that the information you have provided in annex A is full and unredacted. You have made no inidications of any redactions being made. However, after seeing previous Policy notices, it appears clear that this OPN does not follow the layout of your other guidance notices, which leads me to believe that it is not a copy of the original notification *(and therefore stored information)*.

Yours sincerely,

Wayne Pearsall

Dear Mr Pearsall,

Thank you for your email seeking clarification of whether the information released to you in response to FOI request 27354 was redacted.

I have compared the text of Annex A to our response to FOI 27354 and that in the original Word document contained on our staff intranet and can confirm that the content and layout are identical. I can also confirm that no information was redacted.

In terms of layout, the guidance in question was not drafted or issued by the European Operational Policy Team, hence the layout is different to the policy notices we have previously released to you.

I hope this clarifies matters.
