Identifying Housing Benefit claims and compensation for claimants underpaid Income-Related ESA

Dear Department for Work and Pensions,

Plans have now been set out for claimants to be identified and repaid who were underpaid Income-Related ESA on migration from Incapacity Benefit.

Ministers have stated that arrangements relating to arrears of 'passported' benefits are the responsibility of relevant departments.

Housing Benefit is a 'passported benefit' in IRESA cases, in that if a claimant satisfies the means-test for IRESA, that of HB is also satisfied and a maximum award of HB is made. As with many other departments managing 'passported' benefits, Local Authorities administering HB will, like the claimants, not have received correct information on their income and so relevant awards will be inaccurate.

HB is ultimately the responsibility of the DWP, and yet there appear to be no available references at all to how those underpaid HB will be identified and compensated.

I request details of how this is to be done, how Local Authorities and claimants will be informed - and a timescale for action.

It would also be helpful to know if similar information will be made available for the re-calculation of Council Tax Benefit/Council Tax Support claims.
