I refer to your request for information which was dealt with in terms of
the Freedom of Information (Scotland) Act 2002 (FOISA).

 1. Please advise your policy, procedures and training programme for

Response - I have to advise that this information you requested in
questions 1 – 3 is otherwise accessible to you at

(National guidance for child protection in Scotland 2021). I therefore
must refuse your request in terms of Section 25 of FOISA. However, in line
with the duty placed on the Council in terms of Section 15 of FOISA, I can
advise our social work practice is currently informed by both sets of
guidance. We are moving towards full implementation of the updated
National Child Protection Guidance by the end of 2023. Further information

If you are dissatisfied with the way in which your request for information
has been dealt with you are entitled to request a review by writing to the

I refer to your email of 1 April 2023 in which you requested a review of
how we dealt with your request for information dated 6 March. I note that
the response was sent within the 20 working day timescale on 28 March.

I’ve reviewed your request, the response and your request for review and
sought further information from the relevant service.

I am advised that there are no specific policy documents held by the
Council that would fall within the terms of your request and I therefore
have to refuse your request in terms of section 17 of FOISA as information
‘not held’ by the Council.

You should have been advised of that in the response, however, I am
content that it was appropriate in terms of the obligation under section
15 of FOISA to provide you with the links in the response as these contain
relevant information on how Social Work deal with any disclosure by a
child.

If you are dissatisfied with the way in which the review has been dealt
with you are entitled to make an application to the Scottish Information
Commissioner, Kinburn Castle, Doubledykes Road, St Andrews, Fife KY16 9DS
(Tel: 01334 464610) for a review.

You must make representation to the Scottish Information Commissioner no
