AfC Freedom of Information and Subject Access Requests,

Dear Ms Taylor,
I am writing in response to your Freedom of Information request submitted
to the Royal Borough of Windsor and Maidenhead on 27 July. As our
organisation, Achieving for Children (AfC) provides children's services
for this local authority, we are able to provide a response for the
software managed by AfC. The remainder will be supplied by the Council
themselves.
Request
Please can you provide the following information:

1.      The software providers your Local Authority uses for:

management of individual young people
•       Your Children’s Centre Management Information System

2.      The amount paid to these suppliers annually for support and
maintenance.

Response
We manage an Early Years funding system in use in AfC RBWM.  
1 - Servelec Synergy Early Years
2 - We are unable to provide this information as it is exempt under
Section 43(2) of the Freedom of Information Act 2000, where disclosure
would be likely to prejudice commercial interests - please see below. 
3 - September 2024
4 - Any future procurement opportunities will be advertised or awarded via
a relevant procurement framework.
Section 43 (2) of the FOIA provides an exemption from disclosure of
information which would or would be likely to prejudice the commercial
interests of any person, including Achieving for Children. The ICO defines
‘commercial interest’ as “a person’s ability to participate competitively
in a commercial activity i.e. the purchase and sale of goods or services.”
The disputed information consists of the costs of the support and
maintenance of an education management system..

Disclosure of the information requested would be commercially prejudicial
and compromise bargaining positions with any actual or prospective
software suppliers in any forthcoming procurement exercise. Furthermore
disclosing this information would hinder our reputation if organisations
believed that any commercially sensitive information would be open to
public scrutiny once the contract was awarded. This could limit the
interest in Achieving for Children contracts making the process less
competitive. We are satisfied that the information is commercial in nature
and that disclosure would be likely to prejudice the company and Achieving
for Children in a commercial environment. Therefore the disputed
information falls within the scope of the exemption.
