Dear Information Commissioner's Office,
Did MBC give out false information under FOIA - is giving out false information a criminal offence?
How many complaints has the ICO received about Maidstone Borough Council.
How many ICO complaints regarding false information under FOIA?
How many investigations including criminal investigations have been carried out by the ICO?
The following FOIA to MBC should not have had to be resubmitted if accurate information had been provided, as it appears impossible that agents can attend hearings when not instructed correctly.
J E Baring Ltd solicitors and Hardwicke Chambers barristers - did MBC give out false information under the FOIA previously, link below?
1.Did Maidstone Borough Council give out false information previously regarding your external solicitors based in London and barristers also based in London.
As you confirmed that you had never instructed any barristers from Hardwicke Chambers either directly or indirectly or via solicitors Bradley Bloom or Allan Hooper who are both partners of their partnership firm and directors of their company J E Baring Ltd (this company was not registered with the SRA until 14.1.2020) to attend any hearings 12.2.2019, 22.3.2019, 4.6.2019 or 17.10.2019.

Request for Information
Thank you for your recent communications, in which you have made requests
for information held by the Information Commissioner's Office (ICO).
Your requests have been passed to the ICO’s Information Access Team for
consideration under the Freedom of Information Act 2000 (FOIA). They are
currently being dealt with under the reference number shown above.
However, I write to confirm that we will require further information
before we can continue to process your request.
Section 8 of the FOIA describes the criteria that a valid request under
the Act must fill. Section 8(1)(b) states that a valid request will ‘state
the name of the applicant’. The ICO has produced guidance regarding this
part of the Act, stating that:
“A requester can be an individual, a company or an organisation, but in
each case Section 8(1)(b) requires that a request for information must
include the name of the requester. In our view, the intention of the
legislation is for the requester to provide their real name so their
request could be processed in accordance with the requirements of the
FOIA.”
In the definition of what constitutes a ‘real name’ the guidance further
states that:
“Any variation of the requester’s title or first name combined with their
surname (e.g. Mr Smith or John Smith) will be sufficient to meet this
requirement. However, a first name or surname provided in isolation, or a
set of initials, will not.”
While your request does include a name, we have reason to be believe that
it could be a pseudonym. I do acknowledge that this could not be the case
and sincerely apologise for any inconvenience that this could cause, but
because of this we would ask that you provide us with proof of identity.
For instance, a copy of your photo ID or a copy of a household utility
bill.
We would not suggest that you publish such information on the internet via
WDTK, but if you could please email this to ourselves. If you email it to
[1][email address] (further details on contacting us, including our
email address, found [2]here) and include the above reference number
(IC-88351-S1C6) in the subject of your email. It is important to include
the reference number in the email so that it reaches this case record
quickly.
At the point which we receive this information we shall continue to
process your request and aim to respond to you within 20 working days
beginning the day after the clarification is received. Our response to you
can be issued to either the email which you contact us on, the WDTK
generated email address or both dependent on your preference.
Review Procedure
If you are dissatisfied with this response and wish to request a review of
our decision or make a complaint about how your request has been handled
you should write to the Information Access Team at the address below or
e-mail [3][ICO request email].
Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request received
after this time will only be considered at the discretion of the
Commissioner.
If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation. To make such an application, please write
to our public advice department at the address given or visit our website
if you wish to make a complaint under the Freedom of Information Act.

affected by fraud, should be reported to Action Fraud – the UK’s national
fraud and cybercrime reporting centre. If your organisation is in
Scotland, then reports should be made to Police Scotland.

Interesting that the ICO is more interested in covering up for Maidstone Borough Council than stating whether or not giving out false information is a criminal offence !

Why would Maidstone Borough Council want to conceal which legal entities they have instructed their external solicitors through, either the partnership or the company J E BARING LTD?
And that barristers from Hardwicke Chambers have attended previous hearings and carried out work on Maidstone Borough Council's behalf?
Is it because they have previously stated in the negative as to this solicitors partnership acting in pre-hearings and later instructed them for the actual hearing on 11 February 2021 through their company ?
