ICO decision on FOI regarding Blackwall Reach

The request was refused by Tower Hamlets Borough Council.

Dear Tower Hamlets Borough Council,

Please provide all correspondence including the original FOI request that had to finally be dealt with by the ICO on the 27 April 2010. Heres the final decision notice from the ICO;

This should also include all information that was given to the complainant as part of the order set out by this final decision notice by the ICO.

I would also like to see evidence of the council's internal guidance for improvement that was prompted by this final decision to change the way in which it handles EIR, FOI, staff training and also internal record management retrieval techniques, all of which were pointed out as inadequate by the above final decision notice by the ICO.

Dear Mr Iqbal,

Further to your request dated 2 February 2011 I can advise that we will
not be responding to your request for details of the
correspondence relating to the ICO Decision Notice for FER0202121.

The information relating to the ICO investigation has already been
published in the decision notice. To locate, collate and supply the
electronic and paper correspondence - some 200 items would take 20 hours,
which is in excess of the appropriate limit of 18 hours under the Freedom
of Information Act 2000. You may, of course, approach the Information
Commissioner's Office themselves who are also a public authority under the
Act and may have fewer items to locate, collate and supply. You may also,
of course, reduce the scope of your request so that it can be satisfied
within the appropriate limit under the Act. However given the nature of
your original request it is unclear how we can advise you, under our duty
to assist required under Section 16 of the Act, in this regard.

I can confirm that, in response to the Decision Notice issued, the Council
did not supply any additional information to the applicant in the above
mentioned case.

The Council does not hold 'evidence' as you suggest, though continues to
hold training courses and seminars for all staff on Records Management and
other information governance matters and has incorporated the advice
documented by the ICO into those sessions.
