ICO Decision Notice (FS50622653)

We're waiting for Sally Meadows to read recent responses and update the status.

Dear Information Commissioner’s Office,

Paragraph 10 of the Information Commissioner's Decision Notice (FS50622653) refers to a copy of an internal review dated 13 June 2016 that Humberside Police sent to the Commissioner on 11 April 2017.

'10. HP sent the Commissioner a copy of the internal review dated 13 June 2016, on 11 April 2017, explaining that it realised it had not provided the complainant with a copy. HP had upheld its application of section 12.....'

I would like the document disclosing or if it is not held please state so.

Thank you for your email of 11 December 2017 in which you make a request
for information. Your request is being dealt with in accordance with the
Freedom of Information Act 2000 (FOIA).

Dear Information Commissioner’s Office,

I don't think the effort is worth it because your response is virtually as good as stating that the document is not held which would confirm the following (para 12 of the application for permission to appeal to the upper Tribunal):

'12. .....HP never responded to the request for a review. The copy dated 13 June 2016 which the Commissioner refers to in the Decision Notice (para 10) as being sent to her on 11 April 2017 has never been seen by the Appellant and in all probability does not exist. However, the Commissioner states that in the response ‘HP had upheld its application of section 12’. The Commissioner re-commenced her investigation but considered section 14 as HP no longer wished to rely on section 12.'
