On what grounds do the Ministry of Defence claim that British soldiers are at risk of prosecution by the International Criminal Court?

Could the MOD also explain why this assertion is contradicted by the ICC?

Dear Mr Duke-Evans,

In addition to my previous requests, could DJEP please confirm if soldiers accused by IHAT would have the option of having their case heard or prosecuted by the ICC, rather than the Service Prosecution Service.

The reason for this question is that IHAT is proven to be a corrupt organisation and is neither independent nor impartial.

The option of a fair investigation or trial by the ICC is an attractive one considering the government's dishonesty on this issue.
