IBVTA compulsary membership for online vape shops
Dear Department of Health and Social Care,
As an e-cig online retailer i have joined the IBVTA as a member, but the problem we all face is the difficulty in promoting the fact that they are a lot healthier alternative than cigarettes. Even though PHE has recognised this.
We cannot use google, or any social media platforms to advertise e cigarettes as they are not allowed to be promoted due to them being classed as tobacco products. These need to be reclassified.
So as an independant retailer i am asking if it can be addressed and/or discussed that online e-juice and vape sellers have to be IBVTA members, and that e cigaretted be reclassified, this should help to remove those who sell to all and sundry not caring, or are just in it for the money.
Yours faithfully,
Jamie Agnew

Dear Mr/Ms Agnew,
Thank you for your correspondence of 8 July about promotion of
e-cigarettes. I have been asked to reply.
I appreciate your concerns.
E-cigarette adverts are regulated through the Tobacco and Related Products
Regulations 2016, which transposed the requirements of the EU Tobacco
Products Directive (TPD) into UK law. As you are aware, advertising or
promotion, directly or indirectly, of e-cigarettes and re-fill containers
is prohibited on a number of media platforms, including on television,
radio, newspapers and the internet. However, the Committee of Advertising
Practice guidance states that advertisements for nicotine-containing
e-cigarettes not licensed as medicines are permitted on outdoor posters
and on sides of buses.
The best thing a smoker can do for their health is to quit smoking.
E-cigarettes are not free of risk, but the evidence is clear that they are
substantially less harmful than cigarettes. Whilst recognising their
potential benefits to reducing harms to smokers, the Government takes
concerns about e-cigarettes seriously. The Department is monitoring the
effect of regulation and policy on e-cigarettes, including evidence on
safety, uptake, health effects and effectiveness of these products as
smoking cessation aids, to inform our actions on regulating their use.
As you are aware, the Department has asked Public Health England (PHE) to
update its evidence review on e-cigarettes and other novel nicotine
delivery systems annually until the end of this Parliament in 2022. PHE’s
latest review was published in February 2018, and notes that:
o vaping is not risk free, but safer than smoking;
o very few young people take up e-cigarettes permanently;
o poisonings and fires from e-cigarettes are not common; and
o there are still misconceptions that vaping is as harmful as smoking.
I hope this reply is helpful.
Yours sincerely,
Millie Pritchard
