iBus Audio files without a CD

The request was refused by Transport for London.

Dear Transport for London,

I have ready in previous FOI requests made to TfL successful requests for iBus CDs. In this FOI request I just like to request an file with the audio files regarding iBus announcements (not CD). I'd appreciate it sincerely if TfL are able to provide this.

I am absolutely aware that the material within the iBus recordings belong to TfL and I accept not to redistribute/sell/lend etc.

Thank you for your e-mail received on 16 October 2016 asking for an
electronic copy of ibus audio announcements.

 

Your request has been considered in accordance with the requirements of
the Freedom of Information Act and TfL’s information access policy. I can
confirm TfL does hold the information you require.

 

Unfortunately, the electronic files of ibus, of which there are hundreds,
are too large in size to be sent via email. Therefore if you would like a
CD, we would be grateful if you could please send us a postal address
through a private email address.

 

It should be noted that the iBus announcements are recorded as fragments.
As a result, some announcements would not feature in full as the full
announcement would just be made up of two or more fragments that have
already been recorded.

 

Please also note that while access to this material will be provided to
you under the Freedom of Information Act 2000, you are not granted any
rights to any of the intellectual property that exists in it or granted
any permission to make secondary uses of it.

 

TfL owns all intellectual property (including, without limitation,
copyright) in the material supplied and will defend such rights.

 

If you wish to make any secondary use of the material provided, you must
first obtain the consent of TfL (which may be withheld) and, if consent is
granted, a fee may be charged, in accordance with the terms of the Reuse
of Public Sector Information Regulations 2005.

Dear Jasmine Howard,

It would be great if it could be sent electronically, as you are aware I don't want it on a CD. A solution could be that the attachment could be split up in category's. I only really care about North London iBus announcements as I don't live in any other section of London. If it makes it any easier for Transport for London to send it to my email rather than www.whatdotheuknow.com.

I hope you see this as an alternative.

I have been waiting for an response from TfL since the 11th November 2016, yet I have not had a response. Due to the undeniably long overdue of the response I am requesting for an internal review. I personally believe I was patient enough with TfL. Should I still be waiting for an response I then will be contacting the Information Comissioner Office.

Thank you for your emails received by us on 11 November and 21 December
2016. Please accept my sincere apologies for the delay in getting back to
you.

 

Unfortunately it is not possible to filter and extract the ibus files
solely in relation to North London because the data we hold is not
provided in a regional format and therefore would require the manual
extraction and scrutiny of each file, of which there are several hundred,
to determine which ones are relevant for your request. As stated in our
response, the iBus announcements are recorded as fragments and therefore
some announcements would not feature in full as the full  announcement
would just be made up of two or more fragments that have already been
recorded and so in order to provide you with the relevant recordings we
would have to provide you with all of them.

 

You previously mentioned that you do not want these audio files on a CD,
however, in accordance with section 21 of the FOI Act, we are not obliged
to supply you with a copy of the requested information as it is already
accessible to you elsewhere, albeit via CD download. In addition, we refer
you to section 11(4) of the FOI Act where it states “Subject to subsection
(1), a public authority may comply with a request by communicating
information by any means which are reasonable in the circumstances”. As
stated, there are several hundred files that are too large to be sent
electronically. If you do not wish to provide your address then we can
arrange for a copy to be made available for collection at our office in
St. James Park.

 

If you would like a CD sent to you then please provide me with your
address, or alternatively if you wish to collect the CD please let me know
when you are available to do so.
