I would like clarification on when investigation of Fraud regarding Lasting Powers of Attorney is inappropriate.

Dunclan made this Freedom of Information request to Wiltshire Police and Crime Commissioner

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Response to this request is long overdue. By law, under all circumstances, Wiltshire Police and Crime Commissioner should have responded by now (details). You can complain by requesting an internal review.

Dear Wiltshire Police and Crime Commissioner,

I have had an interesting response from Wiltshire Council, regarding the investigation of Fraud/falsifying documents regarding the creation of Lasting Powers of Attorney by the police.

I believe that with all the public outcry about this topic, it needs clarification from the PCC as you are responsible for policing.

Wiltshire Council have stated:

Dear Ms Dunn

Please see the following response to your queries:

"It appears that my question, was misinterpreted, regarding LPA's and staff. My question did not relate to private lives, but LPA's registered on vulnerable adults, that are service users, as this would be a conflict of Interest."

This information is not held as the council would not be aware of any LPAs set up privately within the family where an employee was the LPA. A family member may work for the council and hold LPA for a relative who then requires support, this is a coincidence.

"It also appears that only mis use of funds, would be an issue, not the fact, that someone has created false documents.
The creation of false documents are not investigated by the OPG, I have that confirmed in writing.
They insist this is a police matter, Fraud, please clarify, if Wiltshire Council, think Fraud is the correct safe place, for a service user or vulnerable adults placement. "

If there has been a falsification of documents this would be a matter for the police to investigate if appropriate.

Yours sincerely

David

Dear Police and Crime Commissioner,

Sadly you are incorrect. 417 Corner has banned me from using 101 for General Enquiries, even though this is the correct procedure.
This ban is with the IOPC in a complaint, which was then sent to Wiltshire Professional Standards, no reply as yet.
I also witnessed a crime that I had more information on that I have been unable to supply due to this ban, the public now suffering as a result of that decision.
Force disclosure Unit not responding.

The freedom of Information Act is a legal Act, it would appear that Wiltshire Police are above the Law when abiding by Statute

Yours sincerely,

Dunclan

Dear Police and Crime Commissioner,

Sadly once again you are incorrect. Despite the IOPC informing your Professional Standards Team to communicate with me effectively when upholding my appeal, 417 Corner decided that banning from contact would be effective, completely ignoring the advice from the IOPC. Any more ideas?

Yours sincerely,

Dunclan

Dear Force Disclosure Unit,

It is now a further 3 months waiting for a reply, I will allow two more days then contact the ICO
