I require all detail in reference to crime reference 12200023842 for use as evidence in a civil court case.

We're waiting for Antony Powell to read recent responses and update the status.

Dear North Yorkshire Police, Fire and Crime Commissioner,
Please provide me with all the information North Yorkshire Police holds under crime reference 12200023842.

As the police has opted to not take this matter any further (which I am most annoyed about) I am now perusing the Turners of Turners fabrication Ltd of Foss way Colburn through civil court to recover the cost of the repairs to extensive damage caused by them whilst on my property, Attempting to steal back a vehicle.

Could you also advise me how I am supposed to protect my property when the police have proven to be a waste of time. It is not surprising that people take the law into their own hands when the police take no action and repeatedly push / "Advise" people to deal with crimes like these themselves.

I was warned by a member of the legal profession that this would be the case and this warning has proven very accurate.

If there is a charge for this information which I believe is a maximum of £10 please advise and I will pay it.

Yours very disgruntled

Dear Mr Powell,

I have reviewed your correspondence below and can advise that the Freedom
of Information Act is not the appropriate route of access to information
in these circumstances. Personal Information is exempt from disclosure
under FOI therefore a Section 40 exemption would apply to your request.

You are however entitled to copies of your own personal information under
the Data Protection Act 2018 (S45) commonly known as Subject Access. This
is free and the authority have one calendar month to reply to these
requests. It is worth considering that under Subject Access you are only
entitled to your own personal information; any reports made by, or
information about, another individual will either be redacted (blackened
out) or not supplied all together.  I understand you require information
for use in evidence in a civil court case therefore this disclosure method
may not be most effective as third party details will not be included. We
can provide third party details to you if we have the explicit consent
from that individual to do so. Please see the following on submitting a
subject access request;
[1]https://northyorkshire.police.uk/access-...

Another option is to request the judge produces a court order for
disclosure which orders North Yorkshire Police to disclose all relevant
material into the proceedings. This would include a fee but information
would be un-redacted and shared with all parties of the proceedings.  You
would be required to make this request to the Judge where it would then be
forwarded to North Yorkshire Police.

Please note that it is the Civil Disclosure Unit who would process any
request for Police information and not the Office of the Police, Fire and
Crime Commissioner. Please therefore direct any future correspondence on
the matter to myself or [2][email address]

Please also consider that you may wish to correspond with us via a
personal email address on this matter rather than whatdotheyknow where the
thread of correspondence is published upon the website and viewable by the
wider public.

I hope this assists however please do not hesitate to contact me if you
have any queries.

Kind regards,

Robert Bates

Dear Mr Powell,

I understand that a response to your query has been provided by the Civil
Disclosure Unit for North Yorkshire Police.

As mentioned in previous correspondence, this is not information that our
office holds or that we could obtain to provide to you, because Police &
Crime Commissioner offices are, by law, non operational, and do not
ordinarily have access or permission to share police database record
information.

As this matter has now received a substantive response from the CDU, this
matter is now closed to our office.

Kind regards,

Sharon Caddell
