Dear Warwickshire County Council,
I am writing to ask for an internal review of this decision. I believe the information requested is likely to qualify as information held by WCC. Under paragraph 3(2)(a) of the Environmental Information Regulations 2004, information held by another person on behalf of a public authority qualifies as information held by that authority for the purposes of the Regulations.

You can read the ICO's guidance on what counts as information held by another person on behalf of a public authority here (https://www.pdpjournals.com/docs/8878886...). The ICO advises that this will apply to information by another person as a result of collaborative or co-operative arrangements and specifically cites 'local environmental partnerships' as one example of such an arrangement.

The information requested resulted from a collaboration between WCC, Wellesbourne and Walton Parish Council and Wellesbourne and Walton Flood Action Group, and was funded by WCC. I therefore believe it counts as information held by WCC. If it is not available via WCC's internal systems, it should be obtained from Wellesbourne and Walton Flood Action Group in order to answer this request.

I also believe this would be in accordance with the obligation to progressively make environmental information available to the public under section 4(1)(a) of the Environmental Information Regulations 2004.

Please could you also provide any correspondence between WCC, Wellesbourne and Walton Parish Council and Wellesbourne and Walton Flood Action Group relating to this survey from 01/01/2018-today.
